Meeting consumer needs is dependent upon the conclusion of contracts that are often associated with provisos. Additionally, the promptness of the societies' economic move and emergence of class gap has led one party to imposing unequal terms and ultimately more or perhaps the absolute domination of one's will to collapse and undermine justice and fairness. European states have always attempted to control such terms. This query, through examining the concept and status of unfair terms in the European and Iranian laws and some of the examples of unfair terns stipulated in Directive No. 93/13 of the European Economic Community and considering the opinions of the Imamiyah jurisprudents as to justice and fairness, has come to this conclusion that given the dispersion of the opinions of Imamiyah jurisprudents regarding justice and fairness, these concepts are not an appropriate tool for controlling unfair contractual terms. In this regard, other jurisprudential grounds such as system disorder, unlawful ownership and impossibility of the terns could be employed. Paying attention to lack of a general rule in Iranian laws in controlling these terms highlights this significant issue.}, keywords = {Unfair Terms,Justice and Fairness,European Law,Imamiyah Jurisprudence,Iranian law}, title_fa = {مفهوم و جایگاه شروط غیرمنصفانه در حقوق اروپا و حقوق موضوعه ایران: با رویکردی به عدل و انصاف در فقه امامیه}, abstract_fa = {اصل حاکمیت اراده بنیادیترین قاعده در حقوق خصوصی و دارای آثار مهمی نظیر آزادی قراردادی و امکان خلق الگوهای جدید معاملاتی است. به همین دلیل اصل مزبور از اهمیت و قدمتی طولانی در دو نظام حقوقی غرب و اسلام برخوردار است. اصل حاکمیت اراده، از سویی ریشه در مبانی نظری و مباحث فلسفه حقوق دارد و از سوی دیگر دارای نتایج و کاربردهای فراوان عملی است؛ خصوصاً در زمان ما که گسترش روابط اقتصادی و نیازهای خاص تجاری چارهای جز تحول و نواندیشی در الگوهای قراردادی در سطح ملی و بینالمللی باقی نگذاشته است. چرایی طرح این اصل در هر نظام حقوقی، و مبانی و آثار گرایش به آن، و نیز نخستین نظریهپردازان و پیشینه تاریخی طرح این اصل و تحولات آن سه محور مهمی است که در این مقاله طی دو گفتار جداگانه، ابتدا در نظام حقوقی غرب و سپس در نظام حقوقی اسلام به صورت تطبیقی مورد مطالعه قرار گرفته است. یکی از دستاوردهای این مطالعه، اثبات پیشگامی و تقدم زمانی گرایش به این اصل و پذیرش آثار آن در حقوق اسلام است. ضمناً نادرستی این گفته برخی استادان نیز پدیدار می‌گردد که وضع ماده 10 در قانون مدنی را  «به پیروی از نظریه حقوقیین اروپا» نسبت دادهاند. چندین قرن پیش از آنکه حقوقدانان و فیلسوفان اروپایی به اصل حاکمیت اراده روی آورده باشند، غالب فقهای نامدار امامیه به صراحت چنین نظریه‌ای را ابراز کرده بودند.}, keywords_fa = {شروط غیرمنصفانه,عدل,انصاف,حقوق اروپا,فقه امامی,حقوق ایران}, url = {https://csiw.qom.ac.ir/article_1348.html}, eprint = {https://csiw.qom.ac.ir/article_1348_aeb54a1ce73595675a52722491098895.pdf} }
