In the international legal system, freedom of information and news is regarded as one of the fundamental human rights that, in addition to its inherent importance, possesses a special place due to its operation and support of other rights. Accordingly, on the one hand, it can be said that information has a fundamental and undeniable role in ensuring a democratic society. On the other hand, in international and national legal systems, there is a consensus based in which the scope of freedom of information and information is not absolute, and for which there are limitations that public morals could be referred as one of the most important and ambiguous ones. This article, while studying the concept, position and necessity of freedom of information and news in international instruments and regulations, has examined the nature of public morals in the international legal system and Islam and concludes that in the international legal system a different consideration and interpretation of the concept of public morals was taken into account with regard to the foundations of Islam. Therefore, religious and legal examples are mentioned to assess the limitations of public morals.}, keywords = {Morals,Islam,International Law,News,Information}, title_fa = {آزادی اطلاعات و اخبار و محدودیت اخلاق عمومی در حقوق بین الملل و اسلام}, abstract_fa = {در عصر حاضر آگاهی از رویدادهای زندگی جمعی، از جمله احتیاجات بسیار ضروری انسان، به شمار می­رود. در نظام حقوق بین الملل آزادی اطلاعات و اخبار به عنوان یکی از حقوق اساسی بشر به شمار می­آید که علاوه بر اهمیت ذاتی، به دلیل کارکرد و پشتیبانی آن از دیگر حقوق، از جایگاه ویژه ای برخوردار است. بنابراین از یک سو می­توان گفت که، اطلاعات نقش اساسی و غیرقابل انکار در تضمین یک جامعه دموکراتیک دارد و از سوی دیگر در نظام­های حقوقی بین­المللی و ملی چنین اتفاق نظری وجود دارد که قلمرو آزادی اطلاعات و اخبار مطلق نبوده و برای آن محدودیت هایی ذکر شده است که از جمله مهم­ترین و مبهم­ترین این محدودیت­ها می­توان به محدودیت اخلاق عمومی اشاره نمود. مقاله­ی حاضر ضمن بررسی مفهوم، جایگاه و ضرورت آزادی اطلاعات و اخبار در اسناد و مقررات بین المللی، ماهیت اخلاق عمومی را در نظام حقوق بین­المللی و اسلام بررسی نموده و به این نتیجه رسید که در نظام حقوق بین­الملل تلقی و تفسیر متفاوتی از مفهوم اخلاق عمومی با توجه به مبانی اسلام شده است، لذا در این خصوص مصادیقی دینی و قانونی برای سنجش محدودیت اخلاق عمومی ذکر گردید. }, keywords_fa = {اخلاق,اسلام,حقوق بین‌الملل,اخبار,اطلاعات}, url = {https://csiw.qom.ac.ir/article_1383.html}, eprint = {https://csiw.qom.ac.ir/article_1383_e269914c8f85b0a40676ad5673da31a0.pdf} }
