The present paper has collected the information through a library approach in order to answer the question of legal status of US action in the martyrdom of Major General Soleimani under international responsibility in violation of human rights obligations. This research is based on an assumption according to which US is responsible and the as a result, the related consequences can be sought under international law. Martyrdom of General Soleimani and his companions had been committed by US president direct order, according to his implicit statement. Therefore it is attributed to USA pursuant to article 4 of International law commission’s Draft Articles on Responsibility of States for Internationally Wrongful Acts (ARSIWA 2001),  and has been regarded breach of international obligations of the state in question in the realm of treaty and customary of international human rights. As such, both attribution and breach of international obligation, as two elements of internationally wrongful act have been realized and USA is regarded responsible in accordance with Articles 1 and 2 of ARSIWA 2001. USA as the wrongdoer state must provide a valid and persuasive Assurance of non-repetition (Article 30(b) of ARSIWA 2001), must compensate and provide satisfaction (Articles 36 and 37 of ARSIWA 2001). Satisfaction and Assurance of non-repetition must be valid and real and, in this situation, complete withdrawal of US forces from the region in question and specially Iraq, may make it achievable.  }, keywords = {Martyr Soleimani,United States of America,Trump Administration,Breach of International Obligation,Internationally Wrongful Act,International Responsibility}, title_fa = {مسئولیت بین المللی آمریکا در شهادت سردار سلیمانی}, abstract_fa = {حمله هوایی پهپادی در سرزمین عراق به شهادت سردار قاسم سلیمانی و 9 تن از همراهان ایشان انجامید. مقاله حاضر با روش کتابخانه ای اطلاعات را گردآوردی کرده است تا به مسأله وضعیت حقوقی اقدام آمریکا در شهادت سردار سلیمانی از نگاه حقوق مسئولیت بین المللی در نقض تعهد حقوق بشر پاسخ دهد. جستار حاضر بر این فرضیه مبتنی شده است که آمریکا مسئولیت دارد و بالمآل، به لحاظ حقوقی بین المللی می توان به دنبال پیامدهای آن بود. شهادت سردار سلیمانی و همراهان ایشان به تصریح رئیس جمهور ایالات متحده آمریکا، تحت دستور مستقیم وی بوده است. ازاین رو طبق ماده (4) مجموعه مواد 2001 کمیسیون حقوق بین الملل در زمینه مسئولیت بین المللی دولت ها ناشی از عمل متخلفانه بین المللی، به آمریکا منتسب است و نقض تعهدات معاهداتی و عرفی کشور در زمینه حقوق بین الملل بشر دانسته می شود. بدین ترتیب، هر دو عنصر انتساب و نقض تعهد بین المللی محقق شده و طبق مواد (1) و (2) مجموعه مواد 2001، آمریکا مسئولیت بین المللی دارد. آمریکا به عنوان کشور متخلف باید تضمین معتبر و متقاعدکننده به عدم تکرار بدهد (ماده 30(ب) مجموعه مواد 2001)، غرامت بپردازد و جلب رضایت صورت گیرد (مواد 36 و 37 مجموعه مواد 2001). جلب رضایت و تضمین عدم تکرار باید به طور معتبر و واقعی (غیرصوری) باشد و دراین مورد، این امر با خروج کامل نیروهای آمریکا از منطقه و به ویژه عراق محقق می شود.}, keywords_fa = {شهید سلیمانی,ایالات متحده آمریکا,دولت ترامپ,نقض تعهد بین المللی,عمل متخلفانه بین المللی,مسئولیت بین المللی}, url = {https://csiw.qom.ac.ir/article_1580.html}, eprint = {https://csiw.qom.ac.ir/article_1580_14ade5ee37a0a696c144a11f9ea97843.pdf} }
