Regardless of non-legal motives, the main reason for this is assuming religiosity as a liberty-right in the world human rights system. This has led to the preference of the fundamental right to freedom of expression over religious freedom and has made legal actions against offenders of religion and religious people difficult. Being analytical in terms of the goal, qualitative in terms of processing, and fundamental in terms of results, being conducted as a library research, the present study, through utilizing the Islamic and Western views, seeks to prove that religiosity is beyond liberty-right and is an immunity-right. According to findings of the research and on the basis of numerous philosophical and human rights theories and arguments, because of its proximity to spiritual property, the necessity of paying attention to the dual dimensions of human beings, the necessity of compensating spiritual harm, and the connection between religiosity and human identity, personality and dignity that are protected by human rights, religiosity is an immunity-right and thus must be protected by states and the international community.}, keywords = {Right,religiosity,immunity-right,liberty-right,Hofeld's Theory}, title_fa = {دینداری به مثابه حق-مصونیت بررسی و اثبات بُعد حق-مصونیت دینداری با استفاده از نظریات و قواعد اسلام و غرب درچارچوب نظریه هوفلد}, abstract_fa = {چکیده در دهه‌های اخیر تعرض و اهانت به دین ودینداران رایج شده و نظام حقوق بشر نیز حمایت موثری از آنان انجام نمی‌دهد. فارغ ازانگیزه‌های غیرحقوقی، دلیل اصلی این امرحق–آزادی تلقی شدن دینداری در نظام جهانی حقوق‌بشر است. همین امر باعث ترجیح حقِ بنیادین آزادی بیان بر آزادی مذهبی شده واقدامات حقوقی درمقابل متعرضین به دینداری را مشکل ساخته است. این مقاله که ازنظر هدف تحلیلی، از نظر فرآیند اجرای پژوهش کیفی و ازنظر نتایج پژوهش بنیادی است و با روش کتابخانه‌ای انجام شده، بااستفاده ازنظریات اسلامی وغربی میخواهد اثبات کند، دینداری فراتر ازحق-آزادی بوده و حق-مصونیت است. طبق یافته‌های پژوهش وبراساس نظریات و ادله متعدد فلسفی وحقوق بشری، دینداری به دلیل قرب ماهیت آن به دارایی معنوی، لزوم توجه به ابعاد دوگانه انسان، لزوم جبران ضرر معنوی، رابطه دینداری با هویت وشخصیت وکرامت انسانی که مورد حمایت حقوق بشری هستد،حق–مصونیت بوده وباید مورد حمایت دولت‌ها ومجامع بین‌المللی قرارگیرد.}, keywords_fa = {حق,دینداری,حق- مصونیت,حق-آزادی,نظریه هوفلد}, url = {https://csiw.qom.ac.ir/article_1655.html}, eprint = {https://csiw.qom.ac.ir/article_1655_a354316a377e82edb2a1ff0eae9359bc.pdf} }
