The right to confidentiality of the patient's image therapy in the legal sphere is included in the category of the right to personality and in the realm of Islamic law is in the category of the sin against mankind. On the other hand, these images provide a unique opportunity for physicians in education and research. Given that based on the rights of persons to their image, no one can take a photo or video without the consent of a person, today, some domestic legal systems have provided the conditions for proper use of patient images to protect patients' rights and prevent possible disputes between physician and patient. Non-disclosure of patient identity, informed consent, and safe maintenance are the three main conditions in using patient images. Due to the necessity of finding the right to privacy of patient medical images, the present study, through a descriptive-analytic method, aims to achieve the principles and criteria of protection of this right for legislation in Iran by reviewing and analyzing the results of scientific theories and legal approaches of international centers such as the International Committee of Medical Journal Editors and the Canadian Medical Protective Association has considered and western countries such as Australia, England, and Canada. }, keywords = {image rights,informed consent,privacy,Confidentiality,Medical Images}, title_fa = {حق بر محرمانگی تصاویر درمانی بیمار در حقوق ایران (اسلام) و غرب}, abstract_fa = {استفاده از تصاویری که در طول فرایند درمان و مراقبت توسط پزشک از بیمار تهیه می‌شود می‌تواند حریم خصوصی و حق بر تصویر بیمار را در معرض تهدید قرار دهد و منجر به افشای هویت بیمار شود. حق بر محرمانگی تصویر درمانی بیمار در عرصه حقوقی در زمره حق بر شخصیت و در قلمرو حقوق اسلامی در جرگه حق‌الناس (حق العباد) قرار می‌گیرد. از سوی دیگر، این تصاویر فرصت‌های بی‌نظیری در عرصه آموزش و تحقیق در اختیار پزشکان قرار می‌دهد. با توجه به آنکه بر اساس حق افراد بر تصویر خویش هیچ‌کس نمی‌تواند بدون رضایت از فردی عکس یا فیلم تهیه کند، امروزه تعدادی از نظام‌های حقوقی داخلی به‌منظور محافظت از حقوق بیمار و جلوگیری از ایجاد اختلافات احتمالی میان پزشک و بیمار، شرایط استفاده صحیح از تصاویر بیمار را پیش‌بینی کرده‌اند. افشا نکردن هویت بیمار، اخذ رضایت آگاهانه و نگهداری ایمن سه شرط اصلی در استفاده از تصاویر درمانی بیمار است. با توجه به‌ ضرورت رعایت حق محرمانگی تصاویر درمانی بیمار، پژوهش حاضر به شیوه توصیفی-تحلیلی با هدف دست‌یابی به اصول و ضوابط صیانت از این حق برای قانونگذاری در ایران، بررسی و تحلیل رهاوردهای ناشی از نظریه‌های علمی و نگرش‌های حقوقی مراکز بین‌المللی مانند کمیته بین‌المللی ویراستاران مجلات پزشکی و انجمن حمایت از پزشکی کانادا و کشورهای غربی نظیر استرالیا، انگلستان و کانادا را موردتوجه قرار داده است.}, keywords_fa = {حق تصویر,رضایت آگاهانه,حریم خصوصی,محرمانگی,تصاویر درمانی}, url = {https://csiw.qom.ac.ir/article_1918.html}, eprint = {https://csiw.qom.ac.ir/article_1918_2a51be6987366d594a4104b81bf421fd.pdf} }
