چکیده

همه‌پرسی به مثابه ابزارمستقیم اعمال حق بر تعیین سرنوشت و مشارکت شهروندان، همیشه مورد توجه بوده است. اما پرسش مهم آن است که معیارها و استانداردهای یک "همه‌پرسی خوب" -به عنوان آیینه تمام نمای اراده شهروندان- کدام است و یک همه‌پرسی برای دریافت دیدگاه واقعی شهروندان باید واجد چه اصول و قواعدی باشد و در چه بستری انجام پذیرد؟ در این مقاله با استفاده از روش تحلیلی_توصیفی و با لحاظ تجارب کشور‌های مختلف سعی شده است در عین توجه به فقدان "نظام حقوقی همه‌پرسی" در ایران ، اصول و معیارهای یک همه‌پرسی خوب اصطیاد و فرآیندها و مراحل این پدیده دموکراتیک مورد بررسی قرار گیرد و با تاکید بر لزوم بیشتر راهبری نظام حقوقی بر پدیده همه‌پرسی و خارج نمودن آن از صرف ساحت سیاست، در نهایت تدوین قانون جامع همه‌پرسی پیشنهاد می‌گردد تا در این قانون به صورت شفاف همه عناصر و مولفه های مرتبط با یک همه‌پرسی خوب مشخص گردد.

Referendum, as one of the most important means of exercising the right to self-determination and citizen participation, has always been a matter of concern and has a religious basis as well. But there is an important question what are the Criterion of a "good referendum" - as a mirror of the will of citizens - and what principles and rules should be put in place to get a genuine view of citizens? In this paper, using a descriptive-analytical method and with the experience of different countries, it is attempted to consider the absence of a "referendum legal system" in Iran and the principles and criteria of a good referendum on the processes of this dereferendum legal system" in Iran and the principles and criteria of a good referendum on the processes of this democratic phenomenon. Considered and emphasized on the necessity of more legal guidance on the phenomenon of referendum
