This vulnerability is felt more seriously during armed conflicts that causes perdition, exploitation and abuse of children such as sexual violence against girls, which include violation of their natural rights and human dignity; therefore, they are exposed to some physical and mental disasters. According to the valuable Islamic thoughts and stipulates of the international humanitarian law, the child has the right to be secured his health in a proper manner, under all circumstances, as a perfect human being (whether Muslim or non-Muslim), with disregard to geographic boundaries, language, race, etc. In this descriptive - analytical and comparative study, according to the legal system of Islam and the rules and regulations of  the international humanitarian law, after reviewing the foundations of the right to health of child, effects of armed conflicts on children's health of the victim and involved, and the mechanisms of securing this right, at any case this result has been achieved that the members of  human society, national and international institutions and governments should prevent violence against children in armed conflicts, according to their power and possibilities. In addition, according to Islamic humanitarian law, those who caused harm to the children's health, should be prosecuted and punished as war criminals; While international humanitarian law does not contain any proper sanction, in case of violation of the right to health}, keywords = {Armed conflicts,Children health,violence,International Humanitarian Law,Islam}, title_fa = {حمایت از حق سلامت کودکان در مخاصمات مسلحانه از منظر اسلام و حقوق بشردوستانه بین‌المللی}, abstract_fa = {کودکان از جهت ظرفیت و ظرافت‌های وجودی‌شان، آسیب‌پذیرترین افراد جامعه‌ی انسانی هستند و به دلیل این آسیب‌پذیری نیازمند حمایت می‌باشند؛ این آسیب‌پذیری بیشتر زمانی رخ می‌دهد که مخاصمه مسلحانه‌ای‌ اتفاق ‌افتد و با نادیده‌گرفتن حقوق فطری و شأن و کرامت انسانی موجب هلاکت، استثمار و سوء‌استفاده از کودکان - خصوصاً خشونت جنسی علیه دختران – ‌شود و سلامت جسمی و روانی آنان در معرض خطر قرار گیرد. وانگهی، بر اساس تعالیم ارزشمند اسلام و تصریح حقوق بشردوستانه بین‌المللی، کودک به عنوان یک انسان کامل - خواه مسلمان و یا غیرمسلمان- بدون لحاظ مرزهای جغرافیاییِ مستقر در آن، زبان، نژاد و ... مُحِق است که سلامتی او تحت هر شرایطی به شکل شایسته‌‌ای تأمین شود. در پژوهش حاضر، با روش توصیفی­تحلیلی­تطبیقی، پس از بررسی مبانی حق سلامت کودک، آثار مخاصمات مسلحانه بر سلامت کودکان قربانی و درگیر و سازوکارهای تأمین این حق، با عنایت به نظام حقوقی اسلام و موازین و مقررات حقوق بشردوستانه بین‌المللی، این نتیجه حاصل شده است که بر افراد جامعه‌ی انسانی، نهادهای ملی و بین‌المللی و دولت‌ها لازم است که در حد توان و امکانات، از بروز خشونت علیه کودکان در مخاصمات ممانعت نمایند؛ ضمن این‌که، مطابق حقوق بشردوستانه اسلام، ضرورت دارد افرادی که سلامتی کودکان را در مخاصمات مسلحانه به­هرشکل به مخاطره می‌افکنند، به اتهام جرایم جنگی، تعقیب و محاکمه و مجازات شوند؛ در حالی است حقوق بشردوستانه بین‌المللی، با وجود حمایت از سلامت کودکان و تعهدآوربودن‌شان، در صورت نقض حق سلامت، فاقد ضمانت­اجراهای مناسب و کارآمد هستند.}, keywords_fa = {مخاصمات مسلحانه,سلامت کودک,خشونت,حقوق بشردوستانه بین‌المللی,اسلام}, url = {https://csiw.qom.ac.ir/article_1028.html}, eprint = {https://csiw.qom.ac.ir/article_1028_6280ba63b1b32e0609f52d97874a2a78.pdf} }
