Now, the question is whether this rule is valid, and if the answer is affirmative, is the aforementioned rule applicable in case of price loss before delivery as well? Criticizing the grounds of this rule, this paper has concluded that they are not of sufficient strength. Accordingly, based on the opinion selected by the authors namely the failure of compensation for the weakness of source by the conduct of famous Imamiah jurists, absence of the conduct of wise men for imposing the losses resulted from loss on the seller, possibility of the claimed idjma (unanimity) to have a proof as well as the immediate transfer of ownership upon the contract conclusion, the buyer must suffer the losses. Correspondingly, the rule of article 387 is exceptional and its basis has not been followed by other articles of the Civil Code. It is noteworthy that the Convention on International Sale of Goods (CISG) has adopted this rule and despite confirming the immediate transfer of ownership upon the contract conclusion, has not accepted the transfer of risk to the buyer before delivery.}, keywords = {Destruction of the Sold Object,Delivery,Imamiah Jurisprudence,Article 387 of the Civil Code,CISG}, title_fa = {درنگی مقایسه‌ای بر قاعده تلف مبیع قبل از قبض در ماده 387 قانون مدنی (مطالعه تطبیقی در فقه امامی، حقوق ایران و کنوانسیون بیع بین المللی)}, abstract_fa = {ماده )387( قانون مدنی به پیروی از اندیشمندان فقه امامی، در صورت تلف مبیع پیش از تسلیم به مشتری و بدون تعدی و تفریط بایع، حکم به انفساخ بیع کرده است. حال سؤال این است که این حکم معتبر است یا خیر و بر فرض اعتبار آیا حکم یاد شده در مورد تلف ثمن قبل از قبض نیز مجری است؟ این جستار با نقد مستندات حکم به این نتیجه رسیده که این مستندات از استحکام لازم برخوردار نیست. بر اساس دیدگاه برگزیده نویسندگان مبنی بر عدم انجبار ضعف سند به عمل مشهور، عدم اثبات بنای عقلا در مورد اختصاص زیان ناشی از تلف به بایع، محتمل المدرک بودن اجماع ادعایی و نیز به دلیل انتقال مالکیت به مجرد انعقاد عقد، مشتری باید متحمل زیان گردد و حکم مندرج در ماده (387) استثنایی بوده و سایر مواد قانون مدنی از مبنای آن، پیروی نکرده است. شایان ذکر است که کنوانسیون بیع بین المللی نیز با حکم مزبور موافقت نموده و علیرغم تأیید انتقال مالکیت بمجرد انعقاد عقد، انتقال ضمان به مشتری پیش از تسلیم مبیع را نپذیرفته است.}, keywords_fa = {تلف مبیع,قبض,فقه امامیه,ماده‌ی 387 قانون مدنی,کنوانسیون بیع بین‌المللی کالا}, url = {https://csiw.qom.ac.ir/article_1088.html}, eprint = {https://csiw.qom.ac.ir/article_1088_d1914019f6b235eae39d0acdfbc9335c.pdf} }
