Therefore, despite the well-known disagreement of the jurists, the aggrieved party can claim loss of profit, provided that it is not fictitious and be principally receivable. Similarly, the spiritual damage, in spite of some disagreements in Islamic jurisprudence and international instruments, is supposed to be payable and transferable to other persons. Damage of delay payment, despite the controversy in the Islamic jurisprudence as a result of the depreciation of the value of the money, is claimable and in Afghanistan's law is limited to three percent of the total annual debt. Albeit, when obliging of the non-performing party for compensating of the loss is possible that the damage resulting from the breach of contract is definitive, arising from the breach of the contract, and be foreseeable at the time of the conclusion of the contract, and in Afghanistan's law, the performance by the obligee has been made.}, keywords = {Breach of the Contract,Claim of Damage,Afghan Law,The Jurisprudence,Principles of European Contract Law (PECL),Convention of International Sales of Goods (CISG),Principles of International Commercial Contracts (UNIDROIT)}, title_fa = {خسارات قراردادی قابل مطالبه در حقوق افغانستان، فقه و اسناد بین‎المللی حقوق قرادادها}, abstract_fa = {در حقوق افغانستان،  فقه و اسنادبین‎المللی حقوق قراردادها ناقض قرارداد ملزم است خسارات وارده را بگونه‎ای جبران کند که زیاندیده در وضعیتی قرار بگیرد که چنانچه قرارداد اجرا می‎شد در آن وضعیت قرارمی‎گرفت. ازاین‎رو، علی‎رغم مخالفت مشهور فقها،  به نظر می‎رسد زیاندیده می‎تواند خسارت عدم‎النفع را مطالبه نماید مشروط بر آن‎که نفع از دست رفته اصولاً قابل وصول باشد. هم‎‎چنین، خسارت معنوی با وجود بعضی اختلاف نظرها در فقه و اسنادبین‎المللی حقوق قراردادها از مصادیق ضرر تلقی و قابل جبران و انتقال به غیر می‎باشد. خسارت تأخیر تأدیه نیز علی‎رغم برخی تردیدها در فقه چنانچه ناشی از کاهش ارزش پول باشد، قابل مطالبه بوده و در حقوق افغانستان محدود به میزان سه درصد کل دین در سال می‎باشد. البته، الزام عامل‎زیان به جبران خسارت زمانی میسّر است که خسارت ناشی از نقض قرارداد، قطعی و مستند به تخلف قراردادی بوده و هنگام انعقاد قرارداد، قابل پیش‎بینی و در حقوق افغانستان اجرای تعهد(توسط متعهدله) مطالبه شده باشد.}, keywords_fa = {نقض قرارداد,مطالبه خسارت,حقوق افغانستان,فقه,اصول اروپایی,کنوانسیون بیع,اصول قراردادهای بازرگانی بین‎المللی}, url = {https://csiw.qom.ac.ir/article_1340.html}, eprint = {https://csiw.qom.ac.ir/article_1340_21b2e51fa830feb555e4f98e4a09420b.pdf} }
