Undoubtedly, however, no reference is made to internet type of these crimes in the sources of Islamic law. Therefore, this article by means of examining the different aspects of the aforementioned internet crimes, seeks to determine that how much internet crimes are compatible with Islamic law, and how Islamic law's resources can be used in illustrating and adapting the subject in modern criminal law. The findings of this study indicate that the lack of reference to internet theft and fraud in Islamic law does not authorize non-criminalizing of these crimes in current laws. Accordingly, the lawmaker, through referring to foundations of Islamic law that has banned and determined punishment for fraudulent, deceptive, and criminal offenses for gaining wealth by illegitimate ways, has placed internet crimes under discretionary (ta'zeeri) crimes. So that it would be possible to prevent immunity from these crimes and the orders of Islam based on which these crimes are forbidden would be regarded in the law. The present article, through a descriptive-analytic method and in order to ascertain the possibility of the Islamic law being compatible with Internet theft and fraud, attempts to conduct a comparative study of Islamic law sources approved by the Imamiyah and Sunni jurisconsults with internal regulations.}, keywords = {Islamic Law,Compatibility,Internet Fraud,Internet Theft}, title_fa = {بررسی میزان انطباق پذیری جرایم اینترنتی با حقوق اسلامی (مطالعه موردی سرقت و کلاهبرداری)}, abstract_fa = {با بررسی منابع حقوق اسلامی مشخص می­شود که مبنای جرم­انگاری و مجازات سرقت و کلاهبرداری ، حفاظت از مال مؤمن و غیر مؤمن در مقابل دستبرد یا مالکیت بدون اجازه توسط دیگران است و قاعده­ی احترام مبنای همین موضوع می­باشد. اما قطعاً در منابع حقوق اسلامی اشاره­ای به نوع اینترنتی این جرایم نشده است. به همین دلیل در این مقاله به دنبال آن هستیم که با بررسی جنبه­های مختلف جرایم اینترنتی مذکور مشخص کنیم که جرایم اینترنتی به چه میزان با حقوق اسلامی انطباق دارند و دیگر اینکه منابع حقوق اسلامی چگونه می­توانند در روشن شدن و تطبیق موضوع به کمک حقوق جزای نوین بیایند؟ یافته­های این تحقیق نشان می­دهد که عدم اشاره به سرقت و کلاهبرداری اینترنتی در حقوق اسلام، مجوزی برای عدم جر­م­انگاری این جرایم در قوانین امروزی نیست. به همین دلیل قانونگذار با استناد به مبانی حقوق اسلامی که تقلب و فریب و ارتکاب جرم برای دستیابی به ثروت از طریق روش‌های غیرقانونی را ممنوع اعلام کرده و برای آن ها مجازات تعیین نموده است، جرایم اینترنتی را در زیرمجموعه جرایم تعزیری قرار داده است تا اینکه، هم از بی کیفر ماندن این جرایم جلوگیری شود و هم اینکه دستورات اسلام مبنی بر ممنوع بودن اعمال مذکور در قانون لحاظ شده باشد. مقاله حاضر سعی دارد تا با روش توصیفی-تحلیلی به مطالعه تطبیقی منابع حقوق اسلامی مورد تأیید فقهای امامیه و اهل سنت با قوانین داخلی بپردازد تا امکان تطبیق­پذیری حقوق اسلام با سرقت و کلاهبرداری اینترنتی مشخص شود.}, keywords_fa = {حقوق اسلامی,تطبیق‌پذیری,کلاهبرداری اینترنتی,سرقت اینترنتی}, url = {https://csiw.qom.ac.ir/article_1360.html}, eprint = {https://csiw.qom.ac.ir/article_1360_981f0937ecc99c88b446c2db0427dfb9.pdf} }
