Compensation is considered to be one of the main features of philosophy of being of tort law. Physical damage includes any kind of diya (financial compensation)or arsh (the compensation specified in Islamic law to be paid to the victim or his heirs) caused by any kind of damage to the body such as fractures, defects and disability of the organ, whether partial or general - temporary or permanent, diya of death and treatment costs. It appears that legal systems have different approaches toward the issue and follow different principles for compensable damages. According to the findings of this article –that is conducted in a descriptive-analytic-comparative method- the principle in Iranian and French law is full compensation for these damages. In English law, the purpose of civil liability is not to compensate all damages and for all persons and the courts try to limit the civil liability to compensation of certain damages for certain individuals. In Islamic law, acceptance a principle as to the necessity of compensation for all damages and the expansion of the scope of compensable losses does not contradict the holy law of Islam. However, it cannot be claimed with certainty that it is necessary to accept the principle of compensation for all damages in Islamic jurisprudence.  }, keywords = {Physical Damage,Compensability,The Principle of Full Payment of Damages؛ Physical Harm}, title_fa = {نگرشی بر میزان جبران خسارات بدنی با رویکرد مطالعه تطبیقی درحقوق اسلام، ایران، فرانسه و انگلستان}, abstract_fa = {از جمله خسارات در حوزه مسئولیت مدنی، خسارت بدنی است. جبران خسارت یکی از شاخصه‌های اصلی فلسفه وجودی حقوق مسئولیت مدنی به­شمار می‌آید. خسارات بدنی شامل هر نوع دیه یا ارش ناشی از هر نوع صدمه به بدن مانند شکستگی، نقص و از کار افتادگی عضو اعم از جزئی یا کلی _موقت یا دائم، دیه فوت و هزینه معالجه است. امروزه پیامدهای خسارت مالی این نوع آسیب بسیار سنگین‌تر از گذشته است. به نظر می‌رسد نظام‌های حقوقی برخورد متفاوتی با موضوع داشته و از اصول متفاوتی در باره خسارات قابل جبران پیروی می‌نمایند. بر اساس یافته‌های این مقاله- که به روش توصیفی، تحلیلی و تطبیقی، صورت گرفته است، در حقوق ایران و فرانسه اصل بر جبران کامل این خسارات است. در حقوق انگلیس هدف مسئولیت مدنی، جبران همه انواع ضررها و همه اشخاص نیست و تلاش دادگاه‌ها در محدود نمودن مسئولیت مدنی به جبران ضررهای خاص برای اشخاص مشخصی است. در حقوق اسلام، قبول اصلی به عنوان لزوم جبران کلیه خسارات و گسترش دامنه ضررهای قابل جبران مخالفتی با شرع مقدس اسلام ندارد ولی نمی‌توان با قطعیت مدعی پذیرش اصل لزوم جبران کلیه خسارات در فقه اسلامی شد.}, keywords_fa = {خسارت بدنی,قابلیت جبران,اصل پرداخت کامل خسارت,ضرر بدنی}, url = {https://csiw.qom.ac.ir/article_1652.html}, eprint = {https://csiw.qom.ac.ir/article_1652_6ba6f39c4c44321e06025d5268903a6d.pdf} }
