The drunkenness can lead to the loss or deterioration of will. The fundamental question that arises is what are the similarities and differences between the legal systems of Iran, Islamic jurisprudence and Scotland in this regard? In the present study through a descriptive-analytic method, the most important results are as follows: in each of the mentioned legal systems depriving the will resulting from drunkenness, except if there is a will prior to deprivation of the will to commit a crime (voluntary drunkenness), precludes the criminal liability. The difference is that voluntary drunkenness does not absolve the drunken criminal liability in Scottish criminal law at all because of the element of guilt. This approach is consistent with the well-known position of Islamic jurists regarding drunken murder. In Iranian criminal law, voluntary drunkenness is not recognized as precluding criminal liability if drunkenness is committed with the intent to commit a crime. Albeit, in Iran, drunkenness does not eliminate criminal responsibility for premeditated murder. In addition, identifying the person responsible for proving drunkenness is another difference in these legal systems. The study of Iran's and Scotland's criminal policy on drunkenness implies adopting a rigorous approach (especially in Scotland's criminal law) as to the criminal liability of those who are committing a crime in drunkenness.}, keywords = {Voluntary Intoxication,involuntary intoxication,Drunk to Blame,Scotland,Iran}, title_fa = {تأثیر مستی بر مسئولیت کیفری در حقوق کیفری ایران، اسکاتلند و فقه اسلامی}, abstract_fa = {تبیین نقش مستی در مسؤلیت کیفری مستلزم آگاهی از چگونگی تأثیرگذاری مصرف مسکرات و در نهایت تأثیر مستی در اراده مجرم و همین­طور نوع تفکر و بینش حاکم بر جامعه نسبت به افراد مست است. مستی می­تواند موجب سلب یا تزلزل اراده و قوه تمیز گردد. سوالی بنیادین که مطرح است عبارت است از این­که چه تشابه و تفاوت‌هایی بین نظام‌های حقوقی ایران، فقه و اسکاتلند در این خصوص وجود دارد؟ در پژوهش حاضر با روش توصیفی-تحلیلی اهم نتایج به دست آمده این است که در هر یک از نظام‌های حقوقی یادشده سلب اراده ناشی از مستی جز در صورت وجود اراده سابق بر سلب اراده جهت ارتکاب جرم (مستی ارادی)، موجب انتفای مسؤلیت کیفری می‌شود؛ با این تفاوت که مستی ارادی به­طور مطلق به دلیل وجود عنصر تقصیر، موجب رفع مسؤولیت کیفری از شخص مست در حقوق کیفری اسکاتلند نمی‌گردد که این رویکرد با موضع مشهور فقها در خصوص قتل در حال مستی هم­خوانی دارد. در حقوق کیفری ایران مستی ارادی در صورتی رافع مسؤولیت کیفری شناخته نمی‌شود که مستی با قصد ارتکاب جرم صورت گیرد. البته در ایران مستی موجب انتفای مسئولیت کیفری در قتل عمدی نمی گردد. علاوه بر این، شناسایی مسئول اثبات مستی تفاوت دیگری است که در این نظام‌های حقوقی وجود دارد. مطالعه سیاست جنایی کشورهای ایران، اسکاتلند و فقه اسلامی مبین اتخاذ رویکرد سختگیرانه (به ویژه در حقوق کیفری اسکاتلند) در خصوص مسئولیت کیفری افرادی است که در حال مستی مرتکب جرم می‌شوند.}, keywords_fa = {مستی ارادی,مستی غیرارادی,مست متعدی,اسکاتلند,ایران}, url = {https://csiw.qom.ac.ir/article_1653.html}, eprint = {https://csiw.qom.ac.ir/article_1653_b87793969b9a85fa31de2ddaf300884c.pdf} }
