Having legal personality is one of the theories in managing these challenges that has been proposed to justify the contracts concluded by intelligent systems based on the theory of representation on one side and the attribution of civil liability resulting from the activities of intelligent systems to the systems themselves on the other side. However, a coherent and comprehensive study is not conducted to harmonize the current rules of legal entities and its compliance with the features of intelligent agent. This article seeks to answer the adequacy or inadequacy of theoretical foundations and legal resources to identify legal personality for intelligent agent, which has been written in a descriptive-analytical method with a comparative study of Islamic jurisprudence, Iranian law and law of the West. The findings of this study show that each of these systems have significant theoretical foundations for having legal personality, but the status and characteristics of traditional legal entities are not equally applicable to the features of intelligent agent and if this structure not modified, the identification of legal personality for the systems, despite the alternative solutions, will cause legal confusion}, keywords = {artificial intelligence,intelligent systems,Legal Personality,Capacity,Civil Liability}, title_fa = {بررسی تطبیقی امکان وجود شخصیت حقوقی برای سامانه‌های هوشمند در فقه امامیه، حقوق ایران و حقوق غرب}, abstract_fa = {هوش مصنوعی در بسیاری از ساحت‌های زندگی انسانی وارد شده و چالش‌های حقوقی جدیدی را به وجود آورده است. داشتن شخصیت حقوقی یکی از نظریه‌های مطرح در مدیریت این چالش‌هاست که برای توجیه عقود منعقده توسط سامانه‌های هوشمند بر مبنای نظریه نمایندگی از یکسو و انتساب مسئولیت مدنی ناشی از فعالیتهای سامانه‌های هوشمند به خود سامانه‌ها از سوی دیگر ارائه شده است. با این حال، بررسی منسجم و جامعی در خصوص هماهنگی قواعد کنونی اشخاص حقوقی و تطبیق آن با ویژگی‌های سامانه‌های هوشمند انجام نپذیرفته است. این مقاله به دنبال پاسخگویی به کفایت یا عدم کفایت مبانی نظری و منابع حقوقی برای شناسائی شخصیت حقوقی برای سامانه‌های هوشمند است که به صورت توصیفی تحلیلی با مطالعه تطبیقی بین فقه امامیه، حقوق ایران و حقوق غرب نگاشته شده است. یافته‌های این پژوهش نشان می‌دهند هر یک از این نظام‌ها، مبانی نظری قابل اعتنایی برای داشتن شخصیت حقوقی را دارا می‌باشند اما وضع و ممیزات اشخاص حقوقی سنتی به همان صورت قابل تطبیق بر ویژگی‌های سامانه‌های هوشمند نیستند و در صورت عدم اصلاح این ساختارها، شناسائی شخصیت حقوقی برای سامانه‌ها آن هم با وجود راهکارهای جایگزین، باعث آشفتگی حقوقی خواهد شد.}, keywords_fa = {مصنوعی,سامانه‌های هوشمند,شخصیت حقوقی,اهلیت,مسئولیت مدنی}, url = {https://csiw.qom.ac.ir/article_1749.html}, eprint = {https://csiw.qom.ac.ir/article_1749_bf6daa1f393bcac5431bf1da0e35f408.pdf} }
