Accordingly, in political jurisprudence of Islam, moharebah, that is to say taking up arms in order to create fear and panic and depriving the people of security and comfort is criminalized and severe punishments are provided to tackle with it. In accordance with international instruments, widespread violations of fundamental human rights and freedoms, including political repression and social discriminations are regarded be fundamental causes of violent acts which are criminalized and generally are called terrorism. Western countries, with a broad interpretation of terrorism and following the Additional Protocol I to 1949 Geneva Conventions, have considered the struggles of the liberation movements as an international armed conflict and have accepted fighting against them in the form of terrorism. The authors, through a descriptive-analytic and comparative method and a library-based approach in collecting sources, while expressing the view of Islam and international instruments on terrorism, are seeking to prove that based on the view of Islamic law, the struggles of liberation movements in the form of Islamic jihad are  defensive actions to realize the truth, repel the oppression and eliminate sedition, and confront oppression and arrogance and are right-oriented.}, keywords = {Terrorism,Islamic Jurisprudence,International Instruments,liberation movements}, title_fa = {بازپژوهی تروریسم از دیدگاه حقوق اسلامی و اسناد بین المللی:با تأکید بر نهضت های رهایی بخش}, abstract_fa = {در فقه اسلامی مفاهیمی مانند ارهاب، اغتیال، فتک، بغی و محاربه وجود دارند که هرچند ممکن است کاملاً مترادف مفهوم تروریسم نباشند، ولی چون ازعوامل تهدید کننده امنیت به شمار می روند و از مصادیق «منکر» تلقی می شوند، اسلام با آنها مخالف است. بر این اساس، در فقه سیاسی اسلام، رفتارهایی مانند محاربه، یعنی سلاح برکشیدن به منظور ایجاد خوف و وحشت و سلب امنیت و آسایش از مردم، جرم انگاری و برای مقابله با آن مجازات های شدیدی مقرر شده است. از نظر اسناد بین المللی نیز نقض گسترده حقوق وآزادى هاى اساسى بشر، ازجمله سرکوب سیاسى و تبعیض هاى اجتماعى از موجبات اساسى اعمال خشونت آمیزى است که جرم انگاری شده و عموماً تروریسم نامیده مى‏شوند. در این میان، کشورهای غربی با تفسیری موسّع از تروریسم و به تبعیت از پروتکل اول الحاقی به کنوانسیونهای 1949 ژنو، مبارزه های نهضت های رهایی بخش را یک مخاصمه مسلحانه بین المللی تلقی کرده و مبارزه با آن‏ها را در قالب تروریسم پذیرفته اند. نگارندگان با روش توصیفی-تحلیلی و رویکرد مقایسهاى و شیوه گردآورى منابع به صورت کتابخانهاى، ضمن بیان دیدگاه اسلام و اسناد بین المللی درباره تروریسم، در صددند اثبات نمایند بر مبناى نگرش حقوق اسلامی، مبارزههای نهضت های رهایی بخش در قالب جهاد اسلامى ‏یک «اقدام دفاعى» براى احقاق حق، دفع ستم و رفع فتنه و مقابله با ظلم و استکبار بوده و حق مدارانه است.}, keywords_fa = {تروریسم,فقه,اسناد بین المللی,نهضت های رهایی بخش}, url = {https://csiw.qom.ac.ir/article_1765.html}, eprint = {https://csiw.qom.ac.ir/article_1765_19a252caf18b88d9767dc6b22b1a6e0f.pdf} }
