Given the function of the precaution principle, it is possible that the efficacy of this principle is confused with some other legal institutions and rules in the first instance. Employing a descriptive-analytic method and after introducing the mentioned principle and addressing its constituent elements namely: 1) confronting the suspected risk; and 2) fear of causing a heavy or irreparable damage, the authors in this paper have reached this conclusion that this principle is distinguished from the compensation principle and provisional measure in law of Iran as well as the necessity to preclude the probable damage and Assimilative Capacity Model. However, its function can be justified by the rule of precaution in life, honor and serious properties in Islamic law. Furthermore, we can invoke the ta’zir or the necessity of maintain the System for legislating crimes and the foundation of fault for proving the damage.}, keywords = {suspected risk,prevention principle,Principle of Exemption,The Practical Principle of Precaution}, title_fa = {مطالعه تطبیقی اصل احتیاط در حقوق مدرن وحقوق ایران}, abstract_fa = {«اصل احتیاط» یکی از اصول مهم حقوقی است که در دهه های اخیر حقوقدانان از آن سخن به میان آورده­اند و در حقوق کشورهای متعددی همچون فرانسه، بلژیک و... مورد استفاده قرار گرفته است. این اصل به دنبال آن است که ضرورت پیشگیری از خطر، محدود به خطرات حتمی که خسارات قطعی در پی داشته نگردد بلکه در مواقعی که جامعه در معرض خطرات جدی قرار می­ گیرد که از نظر علمی و فنی رابطه­ ی سببیت میان آن­ها و وقوع زیان به صورت قطعی ثابت نشده است نیز اقدامات مقتضی در جهت احتراز از وقوع خسارات اتخاذ گردد. با توجه به کارکرد اصل احتیاط، ممکن است در ابتدا کارایی این اصل با برخی نهادها و قواعد حقوقی دیگر خلط شود. نویسندگان در این مقاله با استفاده از روش تحلیلی- توصیفی پس از معرفی اصل مذکور و بیان عناصر تشکیل دهنده­ ی آن که عبارتند از: 1-مواجهه با ریسک مظنون 2- بیم وقوع خسارتی سنگین یا جبران ناپذیر، به این نتیجه دست یافته اند که اصل مزبور با اصل جبران خسارت و نهاد دستور موقت در حقوق ایران و همچنین قاعده وجوب دفع ضرر محتمل و مدل ظرفیت سنجی متمایز است اما می­توان در حقوق اسلام کارکرد آن را با قاعده احتیاط در جان، ناموس و اموال خطیر توجیه کرد و برای وضع جرایم به قاعده تعزیر یا وجوب حفظ نظام و برای اثبات خسارت نیز به مبنای تقصیر استناد نمود.}, keywords_fa = {ریسک مظنون,اصل پیشگیری,اصل معافیت,اصل عملی احتیاط}, url = {https://csiw.qom.ac.ir/article_2167.html}, eprint = {https://csiw.qom.ac.ir/article_2167_425aec1463f72ecd122d2e09cb144107.pdf} }
