Since World War II, these interferences are shaped and continued in various forms such as intervention by invitations, agreements, or military assistance. Foreign intervention in the region has not been and is not possible without the permission or support of local entities. What may justify or legitimize permission or accompanying foreigners in Islamic international jurisprudence is the concept of "asking help from non-Muslims", "recourse to non-Muslim" (or Istianat). This article, while examining this notion in the Islamic teachings, compares it with concept of "intervention by invitation" in modern international law and explores the scope and extent of application of "Istianat" in the times of short or long presence of foreign military in Islamic territories. This issue has been raised since the US and its regional allies’ military intervention in Iraq, and now, two decades later, it may be discussed on the current situation in Afghanistan and the Taliban’s return to power. The withdrawal of Western troops from Afghanistan might be considered as a turning point in ending the Western coalition's military intervention in the Islamic territories and future developments in the region.}, keywords = {Military intervention,Recourse to Non-Muslim (Istianat),Intervention by invitation,Islamic International law,Islamic Emirate of Afghanistan}, title_fa = {مداخله بر اساس دعوت در حقوق بین الملل و استعانت از غیرمسلمانان، درنگی بر امارت نوپیدای اسلامی در افغانستان}, abstract_fa = {منطقه خاورمیانه بویژه سرزمینهای اسلامی همواره شاهد انواع دخالتهای نظامی و دیپلماتیک دول اروپایی و غربی بوده است. این دخالتها پس از جنگ جهانی دوم نیز به صور مختلفی از جمله از طریق دعوت، توافق و یا کمک نظامی ادامه یافته است. دخالت بیگانگان در منطقه بدون اجازه و یا همراهی مقامات و حکومتهای محلی مقدور نبوده و نیست. آنچه در ادبیات بین الملل اسلامی می تواند تجویز  و یا همراهی با بیگانگان را قانونی جلوه دهد مفهوم «استعانت از غیر مسلمانان» است. مقاله حاضر، ضمن کاوش این مفهوم در آموزه های اسلامی و تطبیق آن با عنوان «مداخله با دعوت« در حقوق بین الملل معاصر، قلمرو و میزان کاربست مفهوم استعانت را در حضور کوتاه مدت یا دراز مدت قوای نظامی بیگانگان در سرزمینهای اسلامی بررسی می نماید. این بحث از زمان دخالت نظامی آمریکا و همپیمانان منطقه ای آن در عراق مجال طرح یافته و اکنون پس از دو دهه، بر وضعیت کنونی افغانستان و تسلط مجدد طالبان بر این کشور نیز قابل تطبیق است. خروج نظامیان غربی از افغانستان می تواند نقطه عطفی در پایان دادن به مداخله نظامی ائتلاف غرب در سرزمینهای اسلامی و تحولات آینده در منطقه به شمار آید.}, keywords_fa = {دخالت نظامی,استعانت از غیرمسلمان,مداخله با دعوت,بین الملل اسلامی,امارت اسلامی افغانستان}, url = {https://csiw.qom.ac.ir/article_2235.html}, eprint = {https://csiw.qom.ac.ir/article_2235_096d6cd896f2d876eb9b45abddd1dc6b.pdf} }
