This process of global spread, together with an increase in the smuggling due to the economical issue of poverty are among the elements that play a role in female trafficking, resulting in sex slavery and prostitution, while at the same time it takes human dignity and moral heath at a serious risk. As a result, this offence results in social, cultural and moral repercussions in different societies. With a comparative approach, the present study reviews this problem from a legal and jurisprudential point of view, taking a look at the Iranian rules and regulations as well as the relevant international documents. Following some international developments, the Protocol to Prevent, Suppress and Punish Trafficking in Persons, especially Women and Children (also referred to as the Trafficking Protocol or UN TIP Protocol) was rarified by the United Nations General Assembly in 2000. Meanwhile, reports of women and children from Iran having trafficked to some neighboring countries caused the Act against Human Trafficking to be rarified quickly in Iran in 2005 (1383 a. h.).  The present study has an attempt to show that the Iranian legislator has merely taken penal measures, while it has neglected preventive and suppressive ones. It has even neglected the relevant policies. This is while the international documents not only penalize this kind of smuggling; they also take non-criminal, preventive measures as well.}, keywords = {human trafficking,prostitution,penal policies,war (al-moharebeh),Corruption on Earth}, title_fa = {بررسی فقهی حقوقی مقابله با قاچاق زنان با نگاهی به اسناد بین‌المللی}, abstract_fa = {قاچاق زنان درجوامع امروزی، شکل منظم و سازمان‌یافته به خود گرفته و جهانی شده است. فرایند جهانی شدن از یک طرف و افزایش مشتریان خاص زنان قاچاق شده و گسترش فقر و شرایط اقتصادی از عوامل تأثیرگذاری است که ارتباط قاچاق و تجارت زنان را با فحشا و فساد امری غیر قابل انکار می‌‌نماید و کرامت انسانی، سلامت اخلاقی و شخصیت زن را در معرض خطر جدی قرار می‌دهد. در نتیجه، این بزه آثار و پیامدهای شوم و زیانبار اجتماعی، فرهنگی و اخلاقی قابل توجهی در جامعه بر جای می‌‌گذارد. این پژوهش با رویکرد تطبیقی، مبانی فقهی و حقوقی (قوانین و مقررات داخلی) و اسناد بین‌المللی مبارزه با این پدیده را بررسی می‌کند. به دنبال تحولات بین‌المللی، پروتکل راجع به پیشگیری و مبارزه با قاچاق اشخاص به‌ویژه زنان و کودکان، الحاقی به کنوانسیون پالرمو سال 2000، به تصویب اعضای مجمع عمومی سازمان ملل متحد رسید. در این میان، ارائه گزارش‌هایی مبنی بر قاچاق زنان و کودکان از ایران به کشورهای همسایه، سبب شد تا قانون مبارزه با قاچاق انسان در سال 1383 به‌سرعت به تصویب برسد. یافته‌‌های پژوهش حاکی از آن است که قانونگذار ایران صرفاً به اتخاذ تدابیر کیفری اکتفا کرده و از تدابیر پیشگیرانه و حمایتی و حتی اتخاذ سیاست جنایی متناسب غفلت ورزیده است؛ در صورتی که اسناد بین‌المللی مقابله با قاچاق زنان، علاوه بر جرم‌انگاری و برخورد کیفری با این پدیده به پیش‌بینی تدابیر غیرکیفری نیز توجه داشته است.  }, keywords_fa = {قاچاق زنان,فحشا,سیاست‌کیفری,محاربه,افساد فی الارض}, url = {https://csiw.qom.ac.ir/article_560.html}, eprint = {https://csiw.qom.ac.ir/article_560_948dea6553b76e4a6ab8317d91e97cc4.pdf} }
