As a result, respecting the environment has kept to be been significant in all period of man's history. Although respecting the environment has been a concern of contemporary international law, and as a result, it forms the branch of international environmental law, it has not been able to sufficiently protect the environment for the present and future generations. Consequently, this emerges the unity between environment and human rights. So the environmental rights as a new type of human rights instruments were formed in the framework of the third generation of human rights. From the point of view of Islam as a comprehensive religion, there is a strong connection between human beings and the environment. In Islamic teachings, man has an authority over the nature in order to reasonably benefit from it and to prevent it from degeneration. In Islam, as seen in the Quran, this right has been recognized and it is examined from several respects. Specifically, it teaches humanity to use the environment as an instance of divine blessings in which the rights of the future generations are observed.  }, keywords = {Islam,international environmental law,international human rights instruments,integrity law,environmental law}, title_fa = {حق بر محیط‌زیست از منظر حقوق بشر بین‌المللی و اسلام}, abstract_fa = {همواره طبیعت از مهم‌ترین ارکان حیات بشری به شمار آمده است. از این‌رو، احترام به محیط‌زیست در همه‌ی ادوار تاریخی مطمح‌نظر بوده است. ابتدا در حقوق بین‌الملل معاصر سعی بر حمایت از محیط‌زیست شده که در قالب حقوق بین‌الملل محیط‌زیست تبلور یافت اما عدمِ کفایتِ این حمایت و ضرورت حفاظت از محیط‌زیست برای انسان امروز و نسل‌های آینده، ایجاد پیوند میان محیط‌زیست و حقوق بشر مورد توجه قرار گرفت، زیرا حمایت قانونی از حقوق بشر می‌تواند وسیله‌ای جهت نیل به صیانت از محیط‌زیست باشد. از این‌رو، در چارچوب نسل سوم حقوق بشر حق جدیدی به نام حق بر محیط‌زیست در اسناد بین‌المللی حقوق بشری شکل گرفت که در آن محیط‌زیست به عنوان یک حق انسانی مطرح شده است. از منظر اسلام به عنوان یک دین جامع و کامل میان انسان و طبیعت رابطه وجود دارد. در تعالیم اسلامی طبیعت در اختیار انسان‌ها قرار گرفته تا از آن بهره‌برداری معقول نمایند و از اتلاف و نابودی آن خودداری نمایند. چنین حقی در قرآن کریم شناسایی شده و از جنبه‌های مختلفی به آن پرداخته شده است و توصیه شده که از طبیعت به عنوان امانتی الهی استفاده نمایند و حق آیندگان رعایت شود.}, keywords_fa = {اسلام,حقوق بین‌الملل محیط‌زیست,اسناد بین‌المللی حقوق بشر,حقوق همبستگی,حق بر محیط‌زیست}, url = {https://csiw.qom.ac.ir/article_808.html}, eprint = {https://csiw.qom.ac.ir/article_808_1f53005983ba130a563ed508bda9b9bf.pdf} }
