In this school of thought, on one hand, a person has a separate individuality from society and government and is able to provide his or her own definition about the relation between man and universe. Accordingly, the concept of popular sovereignty is intertwined with government representative and in a social contract, people establish the principles of constitution and legitimacy of laws and government are considered as the result of their will and consent. Thus, the most important function of government is to be bound to the representation and guarantee the people’s rights and liberties. A direct relationship can be observed between popular sovereignty and divine sovereignty in religious principles of Iran’s constitution. On one hand, divine sovereignty, is considered as vesting the self- determination right to people by God, as a divine right. On the other hand, people have defined their own destiny within Islamic religious principles, by freely acceptance of sacred principles. So, there is no confliction between religious principles and popular sovereignty, but disputes on sovereignty principles will arises from two different perspectives.}, keywords = {sovereignty,democracy,constitution,religious principles}, title_fa = {حاکمیّت مردم در اندیشه سیاسی غرب و اسلام؛ «نظام دموکراتیک» و «نظام مبتنی بر شریعت مقدس در قانون اساسی ایران»}, abstract_fa = {حاکمیّت مردم در اندیشه سیاسی غرب که در یک نظام دموکراتیک تجلی می‌یابد، از طریق شناسایی فرد به عنوان غایت آغاز می‌شود. در این اندیشه، فرد هویتی مستقل از جامعه و دولت دارد و تواناست تعریف خود از رابطه انسان با جهان هستی را ارائه نماید. بر همین اساس، حاکمیّت مردم، با مفهوم نمایندگی دولت درهم تنیده است و مردم در یک قرارداد اجتماعی، به تأسیس مبانی و اصول قانون اساسی می‌پردازند و مشروعیت قوانین و حکومت را ناشی از اراده و رضایت خود می‌پندارند. بدین ترتیب مهم‌ترین کارویژه­ی دولت این است که به نمایندگی پایبند باشد و حقوق و آزادی‌های مردم را تضمین نماید. در مبانی دینیِ قانون اساسی ایران رابطه مستقیمی میان حاکمیّت مردم و حاکمیّت خداوند مشاهده می‌شود. از یک سو، حاکمیّت الهی بدین معنا تلقی می‌شود که حق تعیین سرنوشت به عنوان یک حق الهی از سوی خداوند به مردم واگذار شده است. از سوی دیگر، مردم با پذیرش آزادانه­ی مبانی شریعت مقدس، حاکمیّت بر سرنوشت خویش را در چهارچوب مبانی دینی اسلام تعریف کرده‌اند. بدین ترتیب، نه­تنها میان مبانی دینی و حق حاکمیّت مردم تعارضی متصوّر نیست بلکه اختلاف در مبانی حاکمیّت از دو دیدگاه مختلف مطرح می‌شود.}, keywords_fa = {حاکمیّت,دموکراسی,قانون اساسی,مبانی اسلام}, url = {https://csiw.qom.ac.ir/article_933.html}, eprint = {https://csiw.qom.ac.ir/article_933_71891820cb1c83028ffd8069c117571a.pdf} }
