One is the right to self-defense and another is military operation to maintain or restore international peace and security. On the other hand, the misconception of the teachings of Islam on Jihad has led to the emergence of Jihadi Takfiri sects. They believe in Elementary Jihad with an ideological purpose; this is in clear contradiction with international regulations. This article is structured through a descriptive-analytic method and of a library based approach and the question of the research is comparing the international standards with ayahs of Qur'an in the field of Jihad in order to determine their conformity. Considering the ayahs related to Jihad confirms the legitimacy and the need for defensive jihad. Defense in its general meaning that has some proponents in contemporary international law has a broad scope and embraces many of the wars which have been regarded as Elementary Jihad in Islamic history and jurisprudence. The results of this article demonstrate a kind of consistency between the material of ayahs of Qur'an and international law as to war and peace. در حقوق بین‌الملل، هرگونه تهدید و توسل به زور ممنوع است و فقط دو استثناء مهم نسبت به آن وجود دارد؛ یکی حق دفاع مشروع و دیگری، عملیات نظامی برای حفظ یا اعاده­ی صلح و امنیت بین‌المللی. از سوی دیگر، برداشت غلط از آموزه‌های اسلام در باب جهاد، به ظهور فرقه‌های­ تکفیری جهادی انجامیده است. اینان، به جهاد ابتدایی با هدف ایدئولوژیک اعتقاد دارند؛ رویه‌ای که در تضاد آشکار با قوانین بین­المللی است. این نوشتار، به شیوه توصیفی تحلیلی و روش کتابخانه‌ای سامان یافته است و مسأله­ی تحقیق، تطبیق موازین بین­المللی با آیات قرآن در موضوع جهاد است تا میزان انطباق این دو را مشخص سازد. بررسی آیات مربوط به جهاد، مشروعیت و وجوب جهاد دفاعی را تأیید می‌کند. دفاع به معنی اعم که در حقوق بین‌الملل امروز طرفدارانی دارد، دامنه­ی گسترده‌ای داشته و بسیاری از جنگ‌ها را که در تاریخ و فقه اسلامی، جهاد ابتدایی تلقّی شده نیز شامل می‌شود. نتایج این مقاله، نوعی هم‌خوانی و هم‌سویی میان مفاد آیات قرآن و حقوق بین‌الملل را در رابطه با جنگ و صلح نشان می‌دهد. https://csiw.qom.ac.ir/article_1433_ab6ec4904bf0eecbf90d81dd3098b287.pdf
