Meaningful participation of citizens in public affairs and the originality of politics is dependent on the strength of the public sphere and actions of individuals in it. Political parties are the most efficient entities of the public sphere, and their freedom and role in construction of politics reveals the status of the public sphere in a political society in the best way. The research method is comparative study with inductive approach. The findings indicate that under Iranian law, despite the fact that the Constitution ensures the freedom of parties in a higher level than Germany, in parliamentary enactments the function of political parties is acting within the existing policies, their establishment mechanism is complex, the way to monitor them is mostly approving, a prior and political and monitoring and enforcement are confused. The inductive extension of the findings to the public sphere results that in Iran the public sphere legally lacks strength and its promotion requires the amendment of laws such as Prties Act in oreder to transparency and clarification and consequently restricting the authority of monitoring bodies, guaranteeing the right to association  as a citizenship rights and recognition of the citizens participation in policy-making. <br />  هدف پژوهش حاضر تبیین جایگاه سپهر عمومی در نظام حقوقی ایران از طریق مقایسه تطبیقی احزاب در حقوق ایران و آلمان است. مشارکت معنادار شهروندان در امور کشور و اصالت سیاست، تابعی از منزلت سپهر عمومی و کنش افراد در قالب آن است. احزاب کارا­ترین نهاد سپهر عمومی هستند و آزادی و نقش آن­ها در ساخت سیاست، آینه تمام­نمایِ منزلت سپهر عمومی در یک جامعه سیاسی است. روش پژوهش، مقایسه تطبیقی با رویکرد استقرایی است؛ یافته­ های پژوهش حاکی از این است که در حقوق ایران، به­رغم این­که قانون اساسی آزادی احزاب را در سطح بالاتری نسبت به آلمان تضمین می­کند، در مصوبات مجلس، کارکرد احزاب، فعالیت در چارچوب سیاست­هایِ از پیش موجود است، سازکار تأسیس حزب پیچیده است، نحوه نظارت بر آن­ها عمدتاً تصویبی، پیشینی و سیاسی است و نظارت و اجرا خلط شده ­اند. تسری استقرایی یافته ها به سپهر عمومی، نتیجه می ­دهد که در ایران سپهر عمومی به لحاظ حقوقی، جایگاه نازلی دارد و ارتقای آن مستلزم بازنگری در قوانینی مانند قانون احزاب، در جهت شفافیت و تدقیق قانون و تبعاً تحدید صلاحیت نهادهای نظارتی، تضمین حق تشکل به­ عنوان یک حق شهروندی و به­ رسمیت­ شناختن مشارکت شهروندان در سیاست­ سازی است. https://csiw.qom.ac.ir/article_1779_dab8574835c9152c9e1c01c502894c5a.pdf
