Journal Article 2023 05 06 Government transition is a critical process in any democratic system, during which a portion of the country's political power held by the executive branch is transferred from the outgoing government—whose legal term is approaching its end—to the newly elected administration. This process varies across legal systems and can lead to different effects and consequences. In Iran, the government transition process is often accompanied by election-related political tension, managerial demotivation due to the nearing end of appointments, inadequate and delayed service delivery by civil servants due to uncertainty and weak supervision, and other factors. As a result, the principle of continuity of public services is disrupted, leading to public dissatisfaction and uncertainty. Using a descriptive-analytical method and through a comparative analysis of the legal frameworks governing government transition in Iran and the United States, this research seeks to answer the following question: What solutions and procedures has the American legal system adopted for optimal government transition, and can they be applied to improve and mitigate the challenges of this process within Iran’s legal system? The findings reveal the existence of a specific legal framework for government transition in the United States and highlight the necessity of enacting a comprehensive, public-law-oriented statute in Iran. Such a law should regulate the entire process—starting from the informal announcement of presidential candidacy to the appointment of various government officials—in a structured and systematic manner. انتقال دولت فرایندی مهم در هر نظام مردم‌سالار است که در جریان آن بخشی از قدرت سیاسی کشور که در اختیار قوه مجریه است، از دولتی که مدت قانونی‌اش روبه اتمام است به دولت جدید منتخب منتقل می‌شود. این فرایند در نظام‌های حقوقی مختلف دارای تفاوت‌هایی است که آثار و پیامدهای متفاوتی را به دنبال دارد. در جریان انتقال دولت در ایران، معمولاً به دلیل انتخاباتی شدن فضای کشور، بی‌انگیزگی مدیران به دلیل نزدیک شدن به پایان مدیریت، عدم ارائه صحیح و به‌موقع خدمات توسط کارمندان به دلیل بلاتکلیفی و ضعف نظارت و... اصل استمرار خدمات عمومی با اختلال مواجه شده که نارضایتی و بلاتکلیفی عمومی را به دنبال دارد. تحقیق حاضر با روش توصیفی‌تحلیلی و تطبیق نظام حقوقی حاکم بر انتقال دولت در دو کشور ایران و آمریکا، به دنبال پاسخ به این سؤال است که نظام حقوقی آمریکا چه راهکار و فرایندی برای انتقال بهینه دولت پیش‌بینی نموده و آیا می‌توان از آن برای بهبود و کاهش مشکلات این فرایند در نظام حقوقی ایران استفاده برد؟ بررسی‌ها نشان‌دهنده وجود قانون مختص انتقال دولت در آمریکا و نیاز به ایجاد قانون جامع و همه‌جانبه‌نگر با نگاه دقیق حقوق عمومی، جهت نظام‌مند شدن این فرایند از زمان شروع واقعی آن یعنی اعلام غیررسمی نامزدی برای انتخابات ریاست‌جمهوری تا انتصاب مدیران مختلف دولتی در ایران دارد. https://csiw.qom.ac.ir/article_2575_c0ec8b858cb5aae0f26999cd6b7f3974.pdf
