In the common law system, two significant approaches, namely the "literal" and "purposive" approaches, exist in opposition to each other, each with its own proponents. This article, while tracing the trajectory of interpretive approaches in the common law system towards the purposive approach and elucidating its important principles such as the "mischief rule" and the "golden rule" of interpretation, seeks to analyze descriptively and analytically whether the purposive approach and to determine the extent to which the principles and rules of the purposive approach are acceptable and applicable in Islamic jurisprudence and the Iranian legal system. The research findings indicate that Islamic jurisprudence places special emphasis on the "text" of the law. However, discussions on topics such as the "Purposes of the Sharia" or similar concepts can be observed in the discourse and opinions of jurists, warranting further investigation. A comparable approach can be observed in Iranian laws and Islamic jurisprudence, indicating a movement towards the purposive approach despite legal pluralism. تفسیر قانون در هر نظام حقوقی ضرورتی انکارناپذر است که همواره نقش مهمی در اعمال قانون و اثرگذاری بر حقوق تابعان آن دارد. در نظام‏ حقوقی کامن ‏لا دو رویکرد مهم «لفظی» و «هدف‏ گرا» در برابر یکدیگر قرار دارد که هریک طرفداران خاص خود را داراست. این نوشتار ضمن ترسیم سیر حرکت رویکردی تفسیری در نظام کامن ‏لا به سوی رویکرد هدف‏ گرا و بیان قواعد مهم آن همچون «قاعده رفع نقص» و «قاعده تفسیر طلایی»، با روش توصیفی تحلیلی به بررسی این مساله می ‏پردازد که آیا رویکرد هدف ‏گرا و به ویژه قواعد مورد اشاره، در فقه و حقوق ایران مشابه یا نمونه قابل تطبیقی دارد؟ یافته‏ های پژوهش حاکی از آن است که فقه تقیّد ویژه‏ ای به «متن» دارد اما با وجود این مباحثی همچون «مقاصد الشریعه» یا عناوین مشابه آن که در کلام و آراء فقها مشاهده می ‏شود قابل تطبیق با رویکرد هدف ‏گرا در کامن ‏لا است. در حقوق و رویه قضایی ایران نیز می ‏توان رویکرد مشابهی را مشاهده کرد که علی ‏رغم پلورالیسم حقوقی بیانگر نوعی حرکت به سمت هدف‏ گرایی است. https://csiw.qom.ac.ir/article_2630_b9131510dc30ed10f1f585e00643f9a1.pdf
