Journal Article 2024 01 21 The principle of good administration of justice requires that all related lawsuits be investigated and dealt with by a single branch. so that the judge can render an appropriate judgment on all aspects of the case and also To avoid conflicting decisions.However, in the Civil procedure of Iran and France, various challenges may occur when joining related cases:If the judge does not find the connection between the lawsuits and examines each case separately and issues their decision, or if related cases are being heard in two branches of the same court and there is a dispute about the existence of a connection between the judges, does the president of the court have the right to resolve the dispute between the judges or not?What should be done if the cases are being heard in two courts with local jurisdiction and there is a dispute between the two courts regarding the existence of a connection between the cases? Or if there is a connection between the cases in absentee proceedings, is it possible to join the cases or not? What is the sanction for violating the joining of related cases? In this article, we are trying to find the challenges of joining related cases in a comparative way. اصل ادارۀ شایستۀ جریان دادرسی در دادرسی مدنی ایران و فرانسه ایجاب می‌کند که به همه دعواهای مرتبط در نزد یک شعبه مورد رسیدگی قرار گیرد تا دادرس با اشراف به همۀ جنبه‌های امر، قضاوتِ شایسته را انجام دهد و نیز از صدور آرای متعارض جلوگیری شود. اما در دادرسی مدنی ایران و فرانسه در جهت ادغام یا تجمیع دعواهای مرتبط چالش‌‌های آیینی مختلفی ممکن است رخ دهد. چنانچه دادرس ارتباط میان دعواها را احراز نکند و با این وجود رسیدگی و رای صادر کند و یا آن که پرونده‌‌های مرتبط در دو شعبه از یک مرجع قضاوتی در حال رسیدگی باشد و درباره وجود ارتباط میان دادرسان اختلاف به وجود آید در این موارد چه باید کرد؟ مقام ارجاع آیا امکان رفع اختلاف را دارد یا خیر؟ چنانچه دعواها در دو مرجع دارای صلاحیت محلی در حال رسیدگی باشد و میان دو مرجع اختلاف رخ دهد چه باید کرد؟ یا آن که چنانچه در رسیدگی واخواهی ارتباط میان پرونده‌‌ها محرز شود نحوه ادغام یا تجمیع پرونده‌ها چگونه خواهد بود؟ ضمانت اجرای نقض رسیدگی همزمان به دعواهای مرتبط چیست؟ ما در این پژوهش به نحو تطبیقی درصدد یافتن چالش‌‌های آیینی ادغام و تجمیع دعواهای مرتبط به ویژه با مطالعه رویه قضایی هستیم. https://csiw.qom.ac.ir/article_2824_d61b694e84fea01bd855b29269d7e8f2.pdf
