Therefore, the fruit of the correct realization of the above principle will be to ensure public security and restore public rights and expand justice. Public rights are among the rights that <br />the government is obliged to guarantee in a society and today they have become very widespread. Public rights in our law cover many areas, including criminal, civil, inheritance matters, commercial, etc, and in addition include many cases, including the right to life, the right to security, the right to health, the right to education, etc. However, the prosecutor in our laws, as the public prosecutor, has a very heavy and extensive duty to protect and defend these rights. Some of these duties and responsibilities are explicitly stated in the<br />text of the law, and some of them can be implicitly and inferred from the content of the legislator's words. In addition, in some other cases, the prosecutor can protect the rights of citizens by performing a supervisory role. In this research, the nature and content of public rights and its position in the laws of Iran, Iraq, and Islam are examined using a descriptive-analytical method and a library collection method that is expanded and expanded by considering various sources, including research and review. While studying the various duties of the prosecutor, we arrive at the issue that defending public rights is one of the main and key duties of the prosecutor and how the prosecutor should protect and safeguard these rights.
