Despite its sanctity and respect, this document may be unable to perform its duties. This inability can be in a partial part, a goal, or the entirety of the constitution. In the constitutional theory, this situation is called constitutional failure. This article, using a descriptive-analytical method and a comparative study, seeks to answer the question of what constitutional failure means. In this article, while examining the types of constitutional failure, an attempt has been made to refer to some of the most important theories of constitutional failure. In addition, the article has also attempted to refer to the issue of constitutional failure and the theory of democracy. The theory of constitutional failure can pave the way for amending and if necessary replacing the constitution or constitutional replacement قانون اساسی سند بنیادین نظام حقوقی است و از جایگاه ویژه‌ای برخوردار است و در مورد آن نظریه‌ها و مفاهیم متعددی شکل گرفته است. این سند علی‌رغم تقدس و احترامی که دارد ممکن است در انجام وظایف خود ناتوان باشد. این ناتوانی می‌تواند در یک قسمت جزیی، یک هدف یا کلیت قانون اساسی باشد. در نظریه حقوق اساسی به این وضعیت شکست قانون اساسی گفته می‌شود. این مقاله با روش توصیفی تحلیلی و با استفاده از مطالعه تطبیقی به دنبال پاسخ به این پرسش است که شکست قانون اساسی به چه معناست. در این مقاله ضمن بررسی انواع شکست قانون اساسی کوشش شده است به برخی از مهم‌ترین نظریه‌های شکست قانون اساسی اشاره شود. علاوه بر این در مقاله کوشش شده است به موضوع شکست قانون اساسی و نظریه دموکراسی نیز اشاره شود. نظریه شکست قانون اساسی می‌تواند راه را برای اصلاح و در صورت لزوم جایگزینی قانون اساسی باز کند.
