Number of theoreticians has tried to answer this important question and each of them has many followers. On one hand, the advocates of “will theory” emphasize on “intention” element and on the other hand, the socialists insist on various criteria based on their pretension. While the economists focus on “efficiency,” the justice-seekers concern about “equity” as a fundamental standard. Meanwhile, the theoreticians who believe in reliance theory have turned away from the intention of promiser theory and focus on the reasonable pondering and legitimate expectations of the promisee instead of the promiser intention. In this article, some of the most important theories regarding contract law especially Reliance Theory which is remedial substitute for defective Intention Theory and also it’s legal consequences will be discussed profoundly and comparatively with Iranian and Islamic Law. <br />  <br /><strong>Keywords:</strong> Intention Theory, Reliance Theory, Reasonable Expectations, Mutual Consent, Equity. مهم‌ترین وجه تمایز تعهدات حقوقی از وعده‌های اخلاقی قدرت اجبار‌‌کننده‌ی آن است که به شکل ضمانت اجرای حقوقی ظاهر می‌شود. این نیروی الزام‌آور از کجا نشات می‌گیرد؟ ضرورت پاسخ‌گویی به این پرسش‌ مهم به ارائه‌ی نظریه‌هایی انجامیده است که هر یک به تفاوت، حامیان بسیار دارند. از یک سو، طرفداران نظریه‌ی اراده بر قصد متعهد تأکید می‌کنند و از سوی دیگر، اجتماعیون با مبنا قراردادن ملاک‌های گوناگون ــ بسته به داعیه‌ای که دارند ــ هر یک بر معیاری متمایز اصرار می‌جویند. اقتصادیون به کارآمدی می‌اندیشند و عدالت جویان بر طبل انصاف می‌کوبند. در این میان، قائلین به نظریه اعتماد به جای اراده‌ی متعهد ، اعتقاد معقول و انتظارات مشروع مخاطب را مطمح نظر قرار داده‌اند. در این مقاله مهم‌ترین نظریه‌های مطرح در حوزه‌ی حقوق قراردادها مورد نقد و بررسی قرار می‌گیرند. در این راستا نظریه اعتماد به عنوان نظریه‌ای که می‌تواند کاستی‌های نظریه اراده را جبران کند با تفصیل بیشتری بررسی، و نتایج مثبت و منفی پای‌بندی به آن ارزیابی شده است، و جایگاه آن در حقوق موضوعه ایران با ملاحظه‌ی مبانی فقهی آن مطالعه خواهد شد.<br /> <strong> </strong><br />   https://csiw.qom.ac.ir/article_724_c136a95a73d335deaae9082f4b752099.pdf
