بررسی تطبیقی چالش‌های حقوقی هوش مصنوعی، در مراقبت‌های بهداشتی در حقوق ایران و اتحادیه اروپا

چکیده

 در سال‌های اخیر، رشد و گسترش سریعی در استفاده از یادگیری ماشینی و سایر رویکردهای هوش مصنوعی شروع شده است. در عرصه پزشکی هوش مصنوعی دارای این ظرفیت است تا اساساً نحوه تصمیم‌گیری در مورد مراقبت‌های بهداشتی و نحوه تشخیص و درمان بیماران را تغییر دهد. سؤال این مقاله این‌گونه مطرح شده است که چالش‌های حقوقی ناشی از هوش مصنوعی در مراقبت‌های بهداشتی چیست؟ یافته‌ها حاکی از آن است که در دو بعد اخلاقی و حقوقی می‌توان به هوش مصنوعی پرداخت، از بعد اخلاقی مسائلی چون رضایت آگاهانه برای استفاده از هوش مصنوعی برای درمان بیمار، شفافیت و ایمنی آن و تعصب الگوریتمی که می‌تواند حتی منجر به نژادپرستی شود مورد توجه قرار گرفت و از دید حقوقی نیز بحث شناسایی مسئولیت، حریم خصوصی و امنیت داده‌های بیماران، مالکیت معنوی و امنیت سایبری مورد تحلیل قرار گرفت. در این زمینه اتحادیه اروپا در گسترهٔ قانون حفاظت از داده‌ها گام‌هایی را برداشته است این در حالی است که در حقوق ایران هیچ قانون مرتبطی با هوش مصنوعی و مراقبت‌های بهداشتی وجود ندارد و تنها می‌توان از برخی از قوانین مباحثی مثل مسئولیت پزشکان، حفاظت از داده‌ها، بحث بهداشت عمومی و حریم خصوصی را تا حدودی استنباط کرد که از جانب قانون‌گذار نیاز به بازبینی دارد.

تازه های تحقیق

پیشرفت‌های مستمر هم در تجمیع داده‌ها و هم در علم کامپیوتر، ظهور هوش مصنوعی را به همراه داشته است. در این میان چالش‌های حقوقی و مسائل اخلاقی در کاربرد هوش مصنوعی در مراقبت‌های بهداشتی همچنان مورد مناقشه است. رضایت آگاهانه و اطلاع بیمار از خطرات احتمالی و چگونگی عملکرد هوش مصنوعی، ایمنی و شفافیت در جهت اطمینان و اعتبار مجموعه داده‌ها و جلوگیری از سوگیری داده‌ها و ایجاد اعتماد در بین ذی‌نفعان همچنین جلوگیری از تبعیض بین افراد از مهم‌ترین چالش‌های اخلاقی به‌کارگیری هوش مصنوعی در مراقبت‌های بهداشتی است. از سوی دیگر مواردی از قبیل شناسایی مسئولیت در هنگام بروز حادثه برای پزشکان یا تولیدکنندگان نرم‌افزارهای مراقبت‌های بهداشتی با توجه به تئوری‌های گوناگون مسئولیت و قواعد مختلف مسئولیت مدنی در بسیاری از کشورها و وجود ابهامات فراوان در این خصوص، به‌عنوان مهم‌ترین چالش حقوقی در این زمینه مورد توجه قرار گرفته است.

اتحادیه اروپا حقوق و قوانین خود را در خصوص هوش مصنوعی در حوزه‌های مختلف به شدت توسعه داده است و چالش‌های مورد اشاره در این مقاله را تا حد مطلوبی مدیریت کرده است، هرچند درزمینهٔ وجود چارچوب هماهنگ قانونی و حقوقی در رابطه با شناسایی مسئولیت دارای نواقصی است که تا حدودی با تصویب قطعنامه و دستورالعمل‌های گوناگون سعی در جبران این نقیصه برآمده است، این در حالی است که با بررسی تمام قوانین ایران در خصوص هوش مصنوعی و مراقبت‌های بهداشتی، می‌توان مدعی شد که بحث هوش مصنوعی، اساساً در این قوانین وارد نشده است و برخی از قوانین مرتبط تنها به داده‌ها در فضای مجازی و اهمیت حریم خصوصی پرداخته‌اند که ناکافی هستند و باید درزمینهٔ پرداختن به هوش مصنوعی و مسائل مربوط به آن مانند مراقبت‌های بهداشتی و هوش مصنوعی، قانون‌گذار بیش‌ازپیش تدقیق کند. چه اینکه با توجه به سرعت پیشرفت این تکنولوژی، عدم ورود قانون‌گذار و عدم توجه به این حوزه، خسارات شدید و جبران‌ناپذیری را بر جای خواهد گذاشت.

The rapid expansion of machine learning and other artificial intelligence technologies has demonstrated a significant potential to transform healthcare decision-making, diagnosis, and treatment. This study undertakes a comparative examination of the legal challenges arising from the deployment of artificial intelligence in the healthcare sector within the framework of Iranian law and European Union law. The central research question concerns the principal ethical and legal issues engendered by the use of AI in healthcare, and the adequacy of the existing legal responses in each jurisdiction. The study identifies and analyses challenges in two interrelated domains. In the ethical domain, the critical concerns addressed include the validity of informed consent where AI systems are integrated into clinical decision-making, the imperatives of safety and algorithmic transparency, and the risk of algorithmic bias productive of discriminatory outcomes. In the legal domain, the analysis encompasses the attribution of civil liability for harm occasioned by AI systems, the protection of patient privacy and personal health data, the safeguarding of intellectual property rights, and the ensuring of cybersecurity in interconnected medical devices and health information systems. The findings reveal a pronounced regulatory asymmetry: the European Union has undertaken extensive and sustained legislative efforts to construct a comprehensive legal architecture for the governance of AI in healthcare, most notably through the General Data Protection Regulation, the proposed Artificial Intelligence Act, and the evolving framework for civil liability, whereas Iranian law continues to lack a dedicated and integrated legislative framework governing artificial intelligence in this domain. Existing provisions concerning medical liability, data protection, public health, and privacy, scattered across disparate enactments, offer only fragmentary and inadequate guidance, and the study concludes that a thoroughgoing legislative revision is an urgent and unavoidable necessity.
