چکیده
تازه های تحقیق
قوه قضائیه بازتاب ارادهی سیاسی ملت است که بر مبنای حق تعیین سرنوشت مردم و در چارچوب نظام نمایندگی قابل نظارت است و انجام وظیفه و مطلوبیت عملکرد این قوه مدنظر مردم و نمایندگان آنهاست. قوه قضاییه بهعنوان شاخهای از قوای تأسیسی، صلاحیت و اعتبار وجودی خویش را از قانون اساسی میگیرد. این قوه باید از رضایت مستمر و پویای حکومت شوندگان نیز برخوردار باشد، بنابراین لازم است در چارچوب بنیادهای حقوق عمومی مدرن این رضایت مورد تحلیل مبنایی قرار گیرد.
قدرت مؤسّس، نظام نمایندگی و ایده تفکیک قوا از مهمترین مبانی نظری قدرت عمومی قوه قضائیه در نظام حقوق عمومی مدرن هستند که علاوه بر تحلیل و شناسایی شالوده قدرت قوه قضائیه، رضایت اراده عمومی مردم را نیز در درون خود به صورت پویا و مستمر همراه خواهند داشت. حکومت در چارچوب پیمان و قرارداد اجتماعی بین صاحبان قدرت در وضع طبیعی و نمایندگان آنها در فرایند تأسیس و تشکیل قدرت برای حمایت و تضمین حقوق طبیعی و بنیادین اعم از حق حیات، مالکیت، آزادی، خوشبختی تأسیس و تشکیل میگردد. قدرت عمومی قوه قضائیه منبعث و برگرفته از اراده عمومی سازندگان اصلی هر نظام سیاسی است که در یک فرآیند انتخابی برای ظهور و بروز اراده مردم در هنگام تأسیس حکومت و در قالب «قانون اساسی»، توسط منتخبین مردم «نهاد مؤسّس اولیه» این قدرت مورد شناسایی واقع میشود و با استفاده از دموکراسی نمایندگی در نظام سیاسی متبلور میگردد تا کارویژه ذاتی تضمین و حمایت از حقوق بنیادین و طبیعی خالقین اصلی و اولیه خودش را به نحو مطلوب انجام دهد. بدینسان این قوه و قدرت قضایی آن جلوهای از اراده مردم است و قاعدتاً آثار و نتایج حاکمیت اراده مردم نیز بر آن تحمیل خواهد شد..

The constitution is the legal and political product of the constituent power in a given state. Accordingly, the judiciary, as an integral component of public power, derives its constitutional authority and institutional legitimacy from the constitution. The inherent function of the judicial system within any political order is to safeguard and protect the rights and freedoms of citizens and to secure the administration of justice - functions firmly established in the political and legal thought of the modern era. In modern political systems, the institutionalization of public law makes it possible for significant dimensions of the representative system, itself deriving from and operating in accordance with the people’s constituent power, to extend to the judicial branch. Within modern public law, the judiciary serves as a guardian of the rights of the people and as a check against the abuse of public power by the other branches; it therefore occupies a distinctive position among the branches of government. The central question of this study is: What theoretical foundations underpin judicial power within the framework of modern public law? The study examines this question in two main parts. It concludes that judicial power, like other forms of public power, reflects the political will of the people and their right to self-determination, and rests upon the public-law foundations of constituent power, representative government, and the separation of powers. Accordingly, the proper exercise and effective performance of judicial functions are ultimately matters of concern to the public and their representatives.
