حق کودکان متعلق به اقلیت‌ها بر تابعیت نگاهی به دیدگاه‌های کمیتۀ حقوق کودک و تعهدات دولت‌ها

چکیده

حق بر تابعیت از چنان اهمیتی برخوردار است که از آن به حق بر حق داشتن یاد می­ کنند. ضرورت برخورداری از این حق برای کودکان متعلق به اقلیت­ها به ­عنوان یکی از آسیب ­پذیرترین اقشار جوامع، ویژگی حیاتی دارد. به­ خاطر اهمیت و ضرورت حق بر تابعیت برای کودکان به­ ویژه در مناطق دارای جمعیت اقلیت، هدف این  مقاله که با استفاده از روش توصیفی-تحلیلی و با بهره‌گیری از داده‌های کتابخانه­ای انجام شده، تحلیل حق کودکان متعلق به اقلیت ­ها ­بر تابعیت در پرتو دیدگاه ­های کمیته حقوق کودک و نیز بررسی تعهدات دولت­ ها در این زمینه است. طبق یافته­ های پژوهش، از نظر کمیته، بهره ­مندی از تابعیت نقشی محوری در برخورداری کودک از دیگر حقوق بشری دارد. تعهدات اصلی دولت ­ها در قبال حق کودکان متعلق به اقلیت­ها بر تابعیت عبارتند از: تعیین جایگاه وضعیت این دسته از کودکان در اولویت ­بندی­های سیاست­گذاری، اصلاح قوانین تابعیتیِ تبعیض ­آمیز، تعیین محل دقیق جهت تأمین اعتبار لازم برای اعطای تابعیت به این دسته از کودکان در لوایح بودجه و دریافت مساعدت از سازمان ­های جامعه مدنی مرتبط با دولت و مستقر در مناطق دارای جمعیت اقلیت، به­ نظر می ­رسد هم به ­لحاظ حقوقی و اخلاقی و هم به ­خاطر مسئله بسیار مهمِ توسعه و ثبات داخلی، یکی از اقدامات ضروری در مناطق دارای جمعیت اقلیت، تجدیدنظر در سیاست­ های تبعیض ­آمیز مربوط به تابعیت و بهره­ مندسازی حداکثری جمعیت اقلیت در کل و خاصه کودکان از تابعیت البته با لحاظ ملاحظات امنیتی دولت­ هاست.

تازه های تحقیق

در جهانِ متشکل از دولت­ها و در حقوق بین­المللی که موجودیت خود را تا اندازه زیادی به شکل­گیری نهاد دولت-ملت در سده­های 15 و 16 میلادی وابسته است، داشتن تابعیت اگرچه شرط برخورداری از حقوق انسانی نیست، ولی در عمل این تابعیت است که میزان و کیفیت بهره­مندی از حقوق را مشخص می­سازد. به این سبب، بی­تابعیتی که فرد را با فقدان هویت حقوقی روبه­رو می­سازد، می­تواند به بی­حقی وی منجر شده و او را در وضعیتی مخاطره­آمیز قرار دهد که در آن، منزلت و حیثیت انسانی­ قابل تصمین نخواهد بود. چنین وضعیتی در جمع با عضویت در یک گروه قومی در کشوری که رفتاری تبعیض­آمیز نسبت به اقلیت­ها روا دارد، فرد را با آسیب­پذیری دوگانه مواجه می­سازد و چنانچه کودک باشد، این آسیب­پذیری شدیدتر نیز می­شود. کودک اقلیتی که از بی­تابعیتی نیز در رنج باشد، از سه حیث، یعنی بی­تابعیتی، در اقلیت بودن و کودکی، در معرض انواع مخاطرات و نقض حق­ها قرار می­گیرد. از این­رو، چنین شخصی نیازمند حمایتی است که با آسیب­پذیری یادشده متناسب بوده و وی را در برابر چنین مخاطراتی، محافظت نماید. اگرچه در نظام بین­المللی حقوق بشر به­ویژه در دو سند برجسته کنوانسیون حقوق کودک و کنوانسیون کاهش بی­تابعیتی از حق کودکان متعلق به اقلیت­ها بر داشتن تابعیت حمایت به­عمل آمده است، ولی به­نظر می­رسد میزان حمایت صورت گرفته از این گروه از کودکان، هیچ تناسبی با شدت آسیب­پذیری آنان ندارد و نمی­تواند ایشان را در برابر رنج­هایی که سه­گانه بی­تابعیتی، عضویت در گروه اقلیت و کودکی را متحمل می­گردند، مورد حفاظت قرار دهد.

ملاحظه شد که شمار کودکانِ بی­تابعیت در میان جوامع اقلیت­ در سطح جهان، در وضعیت نامطلوبی قرار دارد. کودکان در این جوامع با دشواری­های زیادی مواجهند و این مشکلات، در ترکیب با بی­هویتی و در نتیجه بی­حمایتی ناشی از بی­تابعیتی، ابعاد وسیع­تری می­یابد. در واقع، خلأ هویتی برخاسته از بی­تابعیتی در میان کودکان، آسیب­پذیری آنان به­منزله یکی از شکننده­ترین اقشار را دوچندان ساخته است. در بررسی رویه کمیته حقوق کودک، واضح است که کمیته جایگاه رفیعی برای حق کودکان بر تابعیت قائل است. به باور کمیته، برخورداری از تابعیت به­ویژه برای کودکان، جهت بهره­مندی مطلوب از سایر حقوق بشری ضروری بوده و اصلی­ترین کلید جهت گشایش قفل بی­تابعیتی نیز ثبت تولد و اهدای تابعیت بلافاصله پس از ولادت است. با این حال، به اعتقاد این مقاله، سطح توجه به حق بر تابعیت کودکان اقلیت با عنایت به جمعیت چشمگیرِ این قشر آسیب­پذیر در میان اشخاص بی­تابعیتِ جهان به هیچ روی با مخاطره پیش روی آنان تناسب و مطلوبیت ندارد. به نظر می­رسد در این زمینه، آسیب­پذیریِ دوچندان کودکان متعلق به گروه­های اقلیت در نظام حمایت از کودکان در سطح ملل متحد مغفول مانده و محتاج توجه و اقدامات ویژه و اضطراری است.

مستنبط از دیدگاه­های کمیته حقوق کودک و دیگر نهادها و سازکارهای حقوق بشری در زمینه حق کودکان بر تابعیت، دول عضو کنوانسیون حقوق کودک به­لحاظ حقوقی ملزم هستند نسبت به صدور مجوز و حمایت از سازمان­های جامعه مدنی جهت استقرار در بخش­های مرزی قلمروی تحت صلاحیت خود و تهیه و ارائه گزارش مستمر از آمار ازدواج­ها و تولدهای کودکان در این مناطق به دولت اقدام نماید. همچنین، بازنگری در قوانین داخلی و امحای قوانین تبعیض­آمیز در تسری تابعیت به کودکان، از ضروری­ترین اقداماتی است که نه­تنها اسباب برخورداری کودکان بی­تابعیت بسیاری را فراهم ساخته، بلکه از شمار زیادی از بی‌تابعیتی‌های تولدی جلوگیری خواهد نمود. به باور نگارندگان، در کنار دیگر تلاش­های فرهنگی و سیاسی برای حمایت از این قشر آسیب­پذیر، لازم است تصویب سندی بین­المللی و الزام­آور را نیز مدنظر قرار داد که دولت­ها و دیگر بازیگران بین­المللی را به حمایت از حقوق آنان متعهد سازد و سازکاری نظارتی را تعبیه کند که در آن، عملکرد دولت­ها و بازیگران غیردولتی به دقت رصد شود.

The right to nationality is of such fundamental importance that it has been described as a “right to have rights.” The enjoyment of this right is particularly vital for children belonging to minorities, who constitute one of the most vulnerable groups in society. Given the importance and necessity of the right to nationality for children, particularly in regions with minority populations, this article aims to analyse the right of children belonging to minorities to nationality in light of the views of the Committee on the Rights of the Child and to examine States’ obligations in this regard. Employing a descriptive-analytical method, the study finds that, in the Committee’s view, the enjoyment of nationality plays a pivotal role in enabling children to enjoy other human rights. The principal obligations of States concerning the right of children belonging to minorities to nationality include prioritising the status of these children in policymaking, reforming discriminatory nationality laws, making specific budgetary allocations to ensure the necessary funding for the granting of nationality to such children, and obtaining assistance from relevant civil society organisations affiliated with or operating in minority-populated regions. It appears that, for both legal and ethical reasons, as well as in view of the important objectives of domestic development and stability, one of the necessary measures in regions with minority populations is to reconsider discriminatory policies concerning nationality and to maximise access to nationality for minority populations generally, and for children in particular, while taking into account States’ legitimate security considerations.
