چکیده
تازه های تحقیق
این پژوهش تطبیقی با بررسی تحول مفهوم مصونیت دولت در کشورهای اسکاندیناوی (نروژ، دانمارک، سوئد و فنلاند)، ایران و ترکیه و امارات متحده عربی نشان داد که با وجود تفاوتهای حقوقی و فرهنگی و سیاسی، همه این کشورها گرایش مشترکی به پذیرش تدریجی اصل مصونیت نسبی دارند. عوامل اصلی این گذار عبارتاند از: گسترش فعالیتهای تجاری دولتها که مرز میان اعمال حاکمیتی و تصدیگری را کمرنگ کرده است؛ تصویب کنوانسیونهای بینالمللی مهم مانند کنوانسیون اروپایی مصونیت دولتها (۱۹۷۲) و کنوانسیون سازمان ملل متحد (۲۰۰۴) که چارچوبی مشخص برای پذیرش مصونیت نسبی فراهم کردهاند؛ اصلاح قوانین داخلی کشورها؛ پویایی رویه قضایی که با تفسیر پیشرو از حقوق بینالملل، مصونیت نسبی را وارد نظامهای حقوقی کرده است و فشارهای اقتصادیسیاسی و ملاحظات حقوق بشری که بازنگری در مفهوم سنتی مصونیت را ضروری ساختهاند.
کشورهای اسکاندیناوی پیشگام این تحول بودهاند و با آرای قضایی خود در پروندههایی مانند انجمن مسکن شماره ۱۳ علیه پادشاهی بلژیک (۲۰۰۹)، سدلمایر علیه روسیه (۲۰۱۱)، هیوسالا علیه ترکیه (۱۹۹۳) و پروندههای دانمارک و نروژ، مصونیت نسبی را تثبیت کردهاند. این کشورها با تکیه بر سنتهای حقوقی خود و هماهنگی با تحولات بینالمللی، سریعتر از سایر مناطق به این سمت حرکت کردهاند. در مقابل، نظامهای حقوقی ایران و ترکیه با تأخیر بیشتری این تحول را پذیرفتهاند و تا اواخر قرن بیستم به مصونیت مطلق پایبند بودهاند. امارات متحده عربی نیز وضعیتی دوگانه دارد؛ نظام فدرال و محلی هنوز جنبههایی از مصونیت مطلق را حفظ کرده، اما مناطق آزاد تجاری با نظام حقوقی کامنلا رویکردی مدرنتر اتخاذ کردهاند.
دادگاهها در همه این کشورها نقش پیشرو داشتهاند و با تفسیر پویا و تعامل حقوقی میان خود، به همگرایی سریعتر رویه قضایی درزمینهٔ مصونیت نسبی کمک کردهاند. کشورهای اسکاندیناوی به ویژه از طریق اتحادیه حقوقی میان خود، همکاری و تبادلنظر گستردهای داشتهاند. بااینحال، چالشهایی همچون تعیین دقیق مرز میان اعمال حاکمیتی و تجاری، مشکلات اجرای احکام علیه دولتهای خارجی و تعارض منافع ملی با الزامات حقوق بینالملل همچنان باقی است.
برای همگامی بیشتر نظام حقوقی ایران با تحولات بینالمللی درزمینهٔ مصونیت دولت پیشنهاد میشود:
درنهایت، تحول مفهوم مصونیت دولت بازتابی از تغییرات اساسی در ساختار روابط بینالملل و نقش دولتها در عرصه جهانی است. نظامهای حقوقی ملی ناگزیر به انطباق با این تحولات هستند. گرچه سرعت و کیفیت این انطباق متفاوت است، اما جهتگیری کلی به سوی پذیرش مصونیت نسبی، روندی غیرقابل انکار در حقوق بینالملل معاصر است.

Recent developments in public international law have precipitated a fundamental redefinition of the doctrine of state immunity and a decisive shift from the traditional paradigm of absolute immunity towards the modern doctrine of restrictive immunity. This study undertakes a comparative analysis of this transition in four Scandinavian countries - Norway, Denmark, Sweden, and Finland - and three Middle Eastern countries - Iran, Türkiye, and the United Arab Emirates. The particular significance of this inquiry resides in the remarkable diversity of the legal systems under examination: the Scandinavian countries operate within civil law traditions possessing the distinctive characteristics of Nordic legal culture; Iran possesses a mixed legal system incorporating elements of both Islamic law and the civil law tradition; Türkiye has adopted the European civil law model; and the United Arab Emirates features a dual legal system, influenced by Sharia law, which applies civil law alongside common law in its financial free zones. Employing a descriptive-analytical methodology and drawing upon an extensive review of international legal instruments, domestic legislation, and the published case law of the national courts concerned, the study identifies and analyses the principal factors driving this transition, including the expansion of international commercial relations, the normative influence of international conventions, most notably the United Nations Convention on Jurisdictional Immunities of States and Their Property of 2004, the pressures of globalization, and domestic legislative and judicial reforms. The findings demonstrate that, notwithstanding the considerable structural, cultural, and political differences among the countries examined, all are progressing towards the adoption of restrictive immunity, albeit at differing rates and through distinct institutional mechanisms: the Scandinavian countries have advanced more rapidly through dynamic judicial practice and progressive statutory reform, whereas the Middle Eastern countries have proceeded more gradually, primarily through discrete legislative developments. The study concludes with an array of recommendations for the Iranian legal system, including the enactment of comprehensive legislation on state immunity that clearly delineates sovereign from commercial acts, the development of consistent judicial practice, and active participation in international fora addressing issues of state immunity, in order to align domestic law more closely with contemporary developments in public international law.
