مسئولیت مدنی نیابتی فروشندگان مشروبات الکلی در حوادث ناشی از مستی در حقوق ایالت مینه سوتای آمریکا، کانادا و ایران

چکیده

کنترل کردن آثار زیان‌بار مصرف مشروبات الکلی نه تنها در کشورهایی همچون ایران که هر نوع توزیع مشروبات الکلی را غیرقانونی اعلام نموده، بلکه در کشورهایی که چنین تجارت سیاهی را مجاز می‌دانند نیز همواره از دغدغه‌های قانون‌گذاران بوده است. سوال اصلی مقاله حاضر این‌ است که اگر فردی به جهت مصرف مشربات الکلی و مستی، خسارتی به وجود آورد، آیا فروشنده مشروبات الکلی به عنوان سبب ورود خسارت، مسئولیتی در قبال زیان‌دیده دارد؟ پاسخ به این سوال در حقوق کانادا و ایالت مینه سوتا مثبت است ولی تفاوت‌هایی میان این دو نظام حقوقی وجود دارد. با فراهم بودن ارکان مسئولیت، در ایالت مینه‌سوتا مسئولیت مدنی فروشنده، صرفاً در قبال اشخاص ثالثی که از رفتار فرد مست مرتکب خسارت شده‌اند قابل تحقق است ولی در حقوق کانادا، مشتری مست نیز می‌تواند برای جبران خسارات وارده به فروشنده مراجعه نماید. لذا به نظر می‌رسد قواعد مربوط به مسئولیت مدنی فروشندگان مشروبات الکلی در ایالت مینه سوتا بر اساس نظریه خطر و در حقوق کانادا بر مبنای نظریه تقصیر پایه‌ریزی شده است. در حقوق ایران فروش مشروبات الکلی به عنوان سببی برای ورود خسارت است و برای تحقق مسئولیت مدنی برای فروشندگان مشروبات الکلی، لزوم مداخله قانون‌گذار و اصلاح ماده 332 ق.م ضروری می‌نماید.

تازه های تحقیق

در حقوق کانادا و نیز بسیاری از ایالات آمریکا از جمله ایالت مینه سوتا، قانونگذاران راهکار کاهش آثار زیانبار فروش مشروبات الکلی را در وضع مسئولیت مدنی برای فروشندگان یافته‌اند. یکی از تفاوت‌های اساسی بین این دو نظام حقوقی در خصوص ذینفع مطالبه خسارت است. در شرایطی که در ایالت مینه سوتا قواعد مربوط به درام شاپ برای جلوگیری از ورود خسارت به اشخاص ثالث است ولی در حقوق کانادا مشتری مست نیز می‌تواند برای جبران خسارت، علیه فروشنده اقامه دعوی نماید. با تطبیق موارد فوق با حقوق داخلی چنین استنباط می‌گردد که در حقوق ایران نیز فروش مشروبات الکلی به افراد مست و کودکان موجب مسئولیت مدنی خواهد بود، چراکه عمل فروش به چنین افرادی مصداق سبب اقوی از مباشر بوده و مستوجب مسئولیت است. اما در خصوص عرضه مشروبات الکلی به افراد بزرگسال با توجه به اینکه قانون مدنی در فرض اجتماع سبب و مباشر، مسئولیت را بر دوش مباشر قرار داده است، لذا فروشنده فاقد مسئولیت است مگر اینکه عرفاً مقصر تشخیص داده شود. به هر طریق با توجه به آثار مثبت ترسیم قواعد مسئولیت مدنی فروشندگان مشروبات الکلی در کشورهای غربی و آمریکایی، قوانین فعلی ایران نیاز به اصلاح و بازنگری دارند.

Controlling the harmful effects of alcohol consumption has always been one of the concerns of legislators not only in countries like Iran that have declared any type of alcohol distribution illegal, but also in countries that allow such black trade. The main question of this article is that if a person causes damage due to the consumption of alcoholic beverages and drunkenness, is the seller of alcoholic beverages responsible for the damage caused? The answer to this question is positive in the laws of Canada and the state of Minnesota, but there are differences between these two legal systems. With the availability of elements of responsibility, in the state of Minnesota, the civil liability of the seller can only be realized towards third parties who have caused damages due to the behavior of a drunk person, but in Canadian law, a drunk customer can also go to the seller to compensate for the damages. Therefore, it seems that the rules related to the civil liability of alcohol sellers in the state of Minnesota are based on the theory of risk and in Canadian law based on the theory of fault. In Iranian law, the sale of alcoholic beverages is a cause of damage, and in order to realize the civil liability for the sellers of alcoholic beverages, it is necessary for the legislator to intervene and amend Article 332 of the Islamic Law.
