Judicial justice is the basic pillar of human social life and is considered as one of the basic human rights. Nowadays, the responsibility of providing justice and realizing judicial and legal security and hygiene is generally assigned to the governments and especially the general judicial system of countries, however, increasing social and economic interactions and especially commercial exchanges, as well as promoting The level of legal literacy of human beings and the rapid and dramatic changes in the conditions and various fields of human life today have caused a sharp increase in the volume of lawsuits and correspondingly the lengthening of the proceedings and a decrease in the accuracy and quality of proceedings and as a result a decrease in security and judicial justice. In recent decades, the new discourse of private justice has entered the field of judicial justice as a way out and saving solution in order to optimally provide judicial justice and legal hygiene (fair trial) as a helping and facilitating factor. The current research is a research in international documents, which analyzed and described the legal foundations and existing mechanisms and structures of private justice by examining the perspective of the international human rights system and the legal system of Iran and Islam, considering the reasons and existing legal documents. Undoubtedly, the result of this research is to increase the level of awareness and a clearer understanding of the researchers and those involved in the field of justice .
