Evaluating the legal intervention in the right of adult literacy from the perspective of Islamic law and international human rights documents

Abstract

As an example of the right to education, adult literacy is one of the fundamental human rights. Considering the fact that coercion has not been considered in relation to the right to education except in special cases such as primary education, an issue that can be raised is the duty-oriented view of the right to literacy. the present article, in a descriptive-analytical way, tries to explain the legal intervention in the right of adult literacy based on Islamic law and international human rights documents. The findings of the research indicate that, in Islamic law, legal intervention is permitted based on rules such as harmlessness, priority of public interest, negation of mustache and the obligation to preserve the system. despite the priority of the encouraging approach in dealing with the problem of illiteracy, on the assumption that the government has prepared a suitable platform, it will be legitimate to look at the issue of literacy and adopt a punitive approach towards it. in international human rights documents, the text of Article 13 of the International Covenant on Economic, Social and Cultural Rights and the appearance of articles such as Article 29 of the Declaration of Human Rights, Article 4 of the International Covenant on Social, Economic and Cultural Rights and Article 15 of the said Covenant indicate the permission to intervene.
