The Necessity of Legislation and Enforcement in Combating Biopiracy Based on Islamic Law and International Instruments

Abstract

Nowadays, biopiracy, defined as the unauthorized exploitation of traditional knowledge and indigenous genetic resources, is regarded as a serious threat to natural resources and the sustainable use rights of local communities. Considering the necessity of combating this phenomenon, the present study addresses the need for legislation and the effective enforcement of laws against biopiracy based on Islamic law and international instruments. The findings indicate that within the Islamic legal system, the universal human right to natural resources, the precedence right of indigenous communities over their genetic resources, and the sovereignty of states over national public resources are all recognized and respected. Accordingly, biopiracy is condemned as a clear violation of these rights. Likewise, in the international legal system, with the recognition of the principle of national sovereignty over natural resources and the moral rights of indigenous peoples to their local genetic resources, the condemnation of biopiracy is considered a well-established matter. Therefore, combating this phenomenon requires not only the establishment of effective legal frameworks but also special attention to ensuring the proper enforcement of regulations—particularly in light of evidence demonstrating the inefficiency of current laws in addressing this issue
