مهمترین راهکارهای حقوقیِ جمهوریِ اسلامیِ ایران در واکنش به ترور سردار قاسم سلیمانی

چکیده

پس از ترور شهید حاج قاسم سلیمانی توسط ایالات متحده آمریکا، در سوم ژانویه 2020، مساله­ای که میان حقوق­دانان ایرانی و بین المللی از همان ابتدا مطرح شد، واکنش حقوقی دولت جمهوری اسلامی ایران به این واقعه بود. این سئوال اساسی در اذهان شکل گرفت که چه واکنش حقوقی برای مقابله با اقدام غیر قانونی ایالات متحده باید یا می­تواند صورت پذیرد؟ در این راستا دیدگاه­ها، نظرات و راهکارهای متعددی از سوی حقوقدانان ملی و بین المللی مطرح گردید. شکایت در مراجع قضایی بین المللی، طرح مسئولیت جزایی عاملان، دفاع مشروع، اقدام تلافی جویانه و عمل متقابل، طرح مسئولیت بین المللی دولت آمریکا در دیوان بین المللی دادگستری، طرح شکایت در محاکم داخلی و پیگیری­های حقوق بشری جهت محکومیت آمریکا در زمره مهمترین این راهکارها بودند. در این مقاله سعی شده است این پاسخ­های حقوقی در چارچوب قواعد موجود حقوقی بین المللی و ملی ایران و عراق مورد بررسی و ارزیابی قرار گیرد. فرض اساسی این مقاله در پاسخ به سئوال اصلی این است که در میان راهکارهای حقوقی در شرایط فعلی، شکایت در دیوان بین المللی دادگستری مناسب­تر به نظر می­رسد. 

تازه های تحقیق

با توجه به اینکه اقدام آمریکا در به شهادت رساندن چند تن از فرماندهان و نیروهای نظامی رسمی کشور ایران و عراق من جمله فرمانده کل سپاه قدس ایران، سردار شهید حاج قاسم سلیمانی، نقض فاحش قواعد پایه­ای حقوق بین­الملل و مصداق بارز تروریسم دولتی بوده، نظام حقوق بین­الملل و نیز نظام­های حقوقی داخلی کشورها بستر لازم برای طرح مسئولیت دولت آمریکا و نیز مقامات دولتی و فرماندهان این کشور که در این واقعه مشارکت داشته­اند را فراهم نموده­است. از جمله این راهکارها در عرصه بین­المللی توسل به دفاع مشروع و نیز اقدام متقابل است. کشورهای ایران و عراق به خوبی از این دو ظرفیت استفاده کرده­اند. چنان­که اقدام مقتدرانه سپاه پاسداران انقلاب اسلامی در حمله موشکی به پایگاه عین­الاسد در قالب دفاع مشروع قرارگرفته و اقدام مجلس عراق در تصویب خروج نظامیان آمریکایی از عراق، نوعی اقدام متقابل در برابر اقدامات جنایتکارانه آمریکا محسوب می­شود. هم­چنین امکان طرح دعوا در دیوان بین­المللی دادگستری به استناد کنوانسیون راجع به جلوگیری و مجازات جرایم علیه اشخاص مورد حمایت بین­المللی من جمله مأموران سیاسی مورخ 1973 که دولت­های ایران و آمریکا به آن متعهد شده­اند، برای کشور ایران فراهم است. به­علاوه می­توان از ظرفیت نهادهای حقوق بشری سازمان ملل متحد از جمله شورای حقوق بشر و صلاحیت شکایت بین­الدولی کمیته حقوق بشر به عنوان نهاد معاهده­ای ناظر بر میثاق حقوق مدنی و سیاسی در این راستا بهره گرفت. در سطح نظام­های حقوقی داخلی کشورها استماع دعوا در این موضوع در محاکم کشور عراق به دلیل توافقنامه امنیتی این کشور با آمریکا در سال 2008 و شناسایی مصونیت نظامیان و مقامات آمریکایی در عراق، امری بعید به نظر می­رسد. اما امکان طرح دعوا بر مبنای قوانین داخلی حقوقی و کیفری در محاکم کشور آمریکا و به ویژه ایران فراهم است.  خانواده­های بزرگوار شهدا و هم­چنین دادستان به عنوان مدعی­العموم می­توانند در محاکم داخلی ایران به استناد قوانین کافی موجود طرح دعوا نماید اما به دلیل اینکه کشور آمریکا و مقامات آمریکایی اموال زیادی در خارج از آمریکا یا در کشورهای منطقه ندارند، اجرای این آرا ممکن است با مشکلاتی رو به رو شود. به همین دلیل به نظر می­رسد در شرایط فعلی، بهترین راه­حل ممکن طرح دعوا در دیوان بین­المللی دادگستری است.

چکیده [English]

After assassination of Major General Qassem Soleimani on January 2020 by the USA, an issue that arose between Iranian and international jurists from the beginning was the legal response of the Government of the Islamic Republic of Iran to the incident. This key question came to mind that which legal response to US illegal action should or can take place? In this regard, numerous opinions and guidelines were put forward by national and international jurists. Lodging Complaint in international judicial bodies, putting forward the criminal responsibility of the perpetrators, self-defense, reprisal and countermeasure, putting forward the US government's international responsibility before International Court of Justice, lodging complaint before national courts and employing human rights means to condemn US were the most important ones among these guidelines. This paper attempts to examine these legal responses within the context of existing international law and national legal rules of Iran and Iraq. The basic presumption of this article in answering the main question is that among the legal remedies available in the current circumstances lodging a complaint in International Court of Justice seems more appropriate.
