This study, adopting a comparative approach, examines the concept of gender justice in the thought of Allameh Tabatabaei and in feminist discourses. Allameh Tabatabaei, emphasizing the intrinsic dignity and shared human nature of men and women, regards their natural differences not as signs of discrimination but as manifestations of divine wisdom in the order of creation. On this basis, he formulates the theory of “proportional justice,” which, instead of advocating absolute equality, underscores the equitable distribution of rights and duties according to the distinct characteristics and capacities of each gender.
In contrast, many feminist approaches—particularly liberal and radical branches—insist on complete equality between men and women, often interpreting natural differences within the framework of domination and the reproduction of inequality. The present comparative analysis demonstrates that, despite foundational divergences, the possibility of rational and critical dialogue between Islamic thought and feminist theories remains viable.
The study ultimately proposes a native and philosophical model of gender justice that, while remaining faithful to religious foundations, also possesses the potential to address contemporary legal challenges.
