Judgment in Iranian law will be civil if the perpetrator commits a mistake or unconventional negligence by refusing to hear the case, but if he makes a mistake, he will be responsible for compensating the government. The purpose of the comparative study of the present study is to clarify the commonalities and differences between the two schools of Imamiyah jurisprudence and the common law system, which has been done in an analytical-descriptive manner and with a library method, and the findings indicate this.
