چکیده

مسئله اعطای شخصیت به هوش مصنوعی ازجمله نظریاتی است که در جهت مدیریت چالش‌های عملکردی این فناوری مطرح می‌شود. دلایل اصلی لزوم اعطای شخصیت با موضوع مسئولیت و مالکیت نوآوری های ناشی از این سیستم ها در ارتباط است. پرسش مهم آن است که آیا شخصیت حقوقی قابل‌اعطا به سیستم های هوش مصنوعی است؟چه میزانی از شخصیت در این میان قابل اعطا است و موضع نظام حقوقی اسلام و غرب نسبت به این مسئله چیست؟ نوشتار حاضر با روش تحلیلی-توصیفی امکان‌سنجی تعلق شخصیت به هوش مصنوعی را ارزیابی کرده و درادامه به موضع نظام‌های حقوقی اسلام، اتحادیه اروپا، فرانسه و آلمان می‌پردازد. این نوشتار سرانجام نتیجه می‌گیرد که اگرچه نظر به سطوح متفاوت عملکردی انواع هوش مصنوعی، نمی‌توان حکم واحدی برای حدود شخصیت این سیستم‌ها ارائه داد، در میان نظریات مطروحه مانند هوش به مثابه ابزار، محجور، برده و شخصیت کامل، ایده شخصیت طیفی مناسب‌ترین ایده برای تعدیل چالش های مطرح به نظر می‌آید.

چکیده [English]

Granting personality to Artificial Intelligence is one of the controversial issues that has been arisen for management of operational challenges of this technology. The main reasons for the necessity of granting personality are related to the area of responsibility and ownership of innovations due to these systems. The important question is whether the legal personality is grantable to these systems?In the Meantime , How much of this Personality can be granted to these systems? What is the position of Islamic legal systems and western legal systems in this issue? The current article evaluates different types of personality for Artificial Intelligence with the analytical-descriptive method, and investigate the Islamic legal systems, European Union, France and Germany about this issue. This study, in the end, concludes that although a particular sentence cannot be provided for amount of legal personality due to different functional levels of AI types, Gradient legal personality seems to be a suitable choice.
