چکیده

با توجه به اینکه یکی از وظایفی که طبق اصل ١٥٦ قانون اساسی برای قوه قضاییه تعریف شده؛ اقدام مناسب برای پیشگیری از وقوع جرم و اصلاح مجرمین است. بنابراین ثمره تحقق صحیح اصل فوق، تأمین امنیت عمومی و احیای حقوق عامه و گسترش عدل خواهد بود. حقوق عامه از جمله حقوقی است که در یک جامعه، حاکمیت موظف به تضمین آنهاست و امروزه گستره بسیاری یافته است. حقوق عامه در حقوق ما حوزه‌های بسیاری را در بر گرفته از جمله در امور کیفری، مدنی، حسبی، تجارت و غیره و به علاوه شامل موارد متعددی از جمله حق حیات، حق امنیت، حق سلامت، حق بر آموزش و غیره می‌باشد. اما دادستان در قوانین ما به عنوان مدعى‌العموم، وظیفه بسیار سنگین و گسترده‌ای در صیانت و دفاع از این حقوق دارد. برخی از این تکالیف و وظایف به صورت صریح و امری در متن قانون بیان گردیده و برخی دیگر از آنها را می‌توان به صورت ضمنی و از فحوای کلام مقنن برداشت نمود. این تحقیق به روش توصیفی تحلیلی و جمع آوری مطالب به صورت کتابخانه ای است که با مد نظر قرار دادن منابع مختلف اعم از پژوهشی و مروری به بسط و گسترش آن پرداخته و ضمن مطالعه وظایف مختلف دادستان به این موضوع میرسیم که دفاع از حقوق عامه یکی از وظایف اصلی و کلیدی دادستان است و اینکه دادستان چگونه باید از این حقوق صیانت و حراست نماید.

A comparative study of the role of the public prosecutor in fulfilling public rights in Islam, Iranian and Iraqi law

چکیده [English]

Considering that one of the duties defined for the judiciary according to Article 156 of the Constitution; It is an appropriate measure to prevent crime and reform criminals. Therefore, the fruit of the correct implementation of the above principle will be the provision of public security and the restoration of public rights and the expansion of justice. Public rights are one of the rights that the government is obliged to guarantee in a society, and today it has expanded a lot. Public law in our law covers many areas, including criminal, civil, custom, business, etc., and also includes many cases such as the right to life, the right to security, the right to health, the right to education, and so on. But in our laws, the prosecutor, as the public prosecutor, has a very heavy and extensive duty to protect and defend these rights. Some of these tasks and duties are explicitly stated in the text of the law, and some of them can be taken implicitly from the meaning of the legislator's words. This research is a descriptive analytical method and collection of materials in the form of a library, which has been developed by considering various sources, both research and review, and while studying the different duties of the prosecutor, we come to the point that the defense of public rights is one It is one of the main and key duties of the prosecutor and how the prosecutor should protect these rights.
