تقنین مشترک کشورهای اسلامی در حوزه حقوق بشردوستانه

چکیده

کشورهای اسلامی به‌دلیل وجود اشتراکات فراوان درمنابع الهام‌بخش، زمینه بالقوه‌ای را برای همگرایی در موضوعات مختلف دارند. یکی از این موارد، همگرایی از طریق کاربست ابزارهای حقوقی به­ویژه «تقنین مشترک» می‌باشد. تقنین مشترک می‌تواند به دو صورت بین‌المللی (معاهده) یا داخلی (قانون مصوب پارلمان) صورت پذیرد. مسأله اصلی در نوشتار پیش‌رو عبارت است از این که آیا کشورهای اسلامی می‌توانند در زمینه حقوق بشردوستانه، اقدام تقنینی مشترکی بنمایند؟مذاهب مختلف اسلامی، در زمینه احکام و فتاوای مربوط به زمان جنگ و رفتار نظامیان نسبت به افراد، اماکن و اهداف غیرنظامی اشتراکات فراوانی دارند. این اشتراکات، به‌گونه‌ای است که می‌توان بر پایه آن، اقدام به تقنین مشترک نمود. در این مقاله، با تأکید بر وحدت منابع حقوقی کشورهای اسلامی و سایر زمینه‌هایی که وجودشان در وصول به تقنین مشترک، یاری می‌رساند موانع پیش‌رو به‌ویژه در رابطه با چالش‌های هنجاری نیز بررسی شده است.  بر اساس این نوشتار، تقنین مشترک در موضوع­ حقوق بشردوستانه، ضمن رفع خلاء حقوقی داخلی کشورهای اسلامی (به‌دلیل نداشتن آیین‌های قانونمند برای رفتار نظامیان)، منافع متعددی را در عرصه حقوق بین‌الملل نصیب ایشان می‌گرداند. همچنین خنثی­نمودن تبلیغات نادرست در زمینه احکام اسلام و مسأله­ی اسلام­هراسی نیز از نتایج این اقدام، به‌حساب می‌آید. در نتیجه، با توجه وحدت تاریخ، فرهنگ و منابع حقوقی و امکان رفع یا کاهش اثرگذاری موانع موجود، با توجه به وجود برخی سازوکارهای رسمی و غیررسمی لازم در جهان اسلام، قانون­گذاریِ مشترک در این رابطه به عنوان یک نیاز ضروری و دست‌یافتنی ارزیابی می‌گردد.

تازه های تحقیق

آنچه در این نوشتار پردازش و تحلیل شد، لزوم توجه به تقنین مشترک در حقوق بشردوستانه توسط کشورهای اسلامی بود. ضمن بررسی زمینه‌های تسهیل‌کننده­ی دستیابی به این هدف، چالش‌های هنجاری و موانع عینی دستیابی به آن نیز مورد توجه و بحث قرار گرفت. به‌نظر می‌رسد با توجه به وجود احکام اسلامی غنی در زمینه حقوق بشردوستانه و عمل مسلمانان به بخش عظیمی از احکام، با توجه به تجربیات مورد اشاره در این نوشتار، چالش‌های یادشده را می‌توان با ظرفیت‌سازی در یک دوره‌ میان‌مدت، پشت‌سر گذاشت.

همچنین به‌نظر می‌رسد با توجه به ظهور منازعات مسلحانه داخلی و بین­المللی در جهان اسلام و تنوع و تعدد دولت‌ها و گروه‌های درگیر در جنگ، لزوم اقدامی فراملی در سطح کشورهای اسلامی، ضرورتی اجتناب­ناپذیر است. از این‌رو تلاش برای تقنین مشترک در هر یک از سطوح سه‌گانه­ی یادشده، با هر انداره از موفقیت، برای کشورهای اسلامی امری مطلوب و ضروری ارزیابی می‌شود. با توجه به نیاز جهان اسلام - چه در سطح نخبگانی و چه در سطح عموم مردم - به حکمفرمایی اخلاق اسلامی به رفتار نظامیان نسبت به افراد، اماکن و اهداف غیرنظامی، باید آمادگی کافی برای ارائه راهکار در جهت پاسخ به این نیاز با ابزارهای حقوقی فراهم آید.

چکیده [English]

    There are many potentials in Islamic countries legal systems to pace toward legal integration. One of them is common resources of law which can be used to have “Common Legislation”. Common Legislation can take place in forms of inter-governmental (treaties) or internal (approved acts by parliaments). The main question here, is that whether the Muslim States can take common legislative measures on humanitarian law? Various Islamic schools (Mazaheb) have communal resources, regulations and verdicts in the realm of humanitarian law which can be used to have a common legislation. In result, this article is to analyze the common legislation of Islamic countries on humanitarian law: necessity, possibility, barriers and normative challenges facing in this regard. According to this article, Common legislation in the Islamic countries and Muslim world, yields many benefits specially to frustrate Islam phobia. According to this article, common legislation in Muslim World on humanitarian law would be necessity any also available because of many possibilities such as common history, culture, resources and removability of barriers or reducing their influence.
