نقش مشارکت مردم در وضع مقررات شهری؛ مطالعه تطبیقی در حقوق غرب و ایران

چکیده

حق تعیین سرنوشت می تواند ابعاد مختلفی را به همراه داشته باشد از جمله در ساحت محلی و در نقشی که شهروندان می توانند در مقررات­ گذاری­ های محلی-شهری برعهده داشته باشند. این پژوهش سازوکارهای های مشارکت شهروندان در روند مقررات­ گذاری از نقطه­ نظر شوراهای محلی را مورد بحث قرار می­ دهد و با استفاده از مطالعات تطبیقی، مصادیق و مدل­های گوناگون این مشارکت را بیان می ­نماید. علیرغم تجارب خوبی که در کشورهای پیشرو در این حوزه برای مشارکت دادن شهروندان در فرآیند مقررات­ گذاری شاهد هستیم، نتایج پژوهش نشان می ­دهد در ایران گرچه امکان استنباط کلی این مشارکت از اسناد حقوقی بالادستی وجود دارد، اما سازوکارهای این قسم از مشارکت در وضع مقررات محلی در ایران وجود ندارد یا بسیار ضعیف و نحیف است. عدم امکان مشارکت منظم و منطقی شهروندان در مقررات­ گذاری می ­تواند از مهم ­ترین علل ناکارآمدی و عدم میل به اطاعت از مقررات شهری و بالارفتن هزینه­ های اقتصادی و اجتماعی اجرای تصمیمات شوراهای شهر باشد.

تازه های تحقیق

مشارکت شهروندان در وضع مقررات می تواند از مشارکت منفعل از جمله در قالب حضور در نشست ها و مباحثات عمومی تا مشارکت فعال در قالب تهیه پیش نویس قوانین و نیز همه پرسی متجلی گردد. هر سیستم دموکراتیک مناسب دولت محلی برای انجام وظایف خود و تطبیق با اصول دموکراتیک تعیین شده موظف است که اشکال مشارکت مستقیم شهروندان در روند تصمیم گیری در موارد دارای اهمیت محلی را در بر گیرد. از آنجاییکه شهروندان هیچ اختیار قانونی برای تصمیم گیری درباره مسائل مختلف ندارند، احتمال مشارکت آنها در فرآیند ایجاد فرم های دموکراتیک و مشارکت آنها در تقریبا تمام نظام های محلی، به موجب مقررات قانون اساسی، قوانین عادی و عموما مقررات محلی مقررات گذاری می گردد.

در خصوص نظام حقوقی ایران همپای نقش مستقیم گمشده شهروندان در خصوص امر قانونگذاری،مشارکت شهروندان در مقررات گذاری های شهری نیز مغفول باقی مانده است و البته تجربه ناموفق شوراهای شهر در ایران نتوانسته است وارد فضای مشارکت دادن بیشتر شهروندان در مرحله پیشنهاد یا بررسی یا درخواست لغو مقررات شهری شود هرچند می توان اصل این مشارکت شهروندان را از متون اساسی استنباط نمود.زمزمه هایی که برای نقش بیشتر شهروندان در مقررات گذاری های شهری از مجلس شنیده میشود امیدوار کننده است ولی مشخص نیست با توجه به ضعف هنجاری و رفتاری شوراهای شهر و عدم نقش افرینی شایسته توسط شورای شهر در کشور، چقدر بتوان به تصویب و اجرای قواعد قانونی ناظر بر مشارکت مزبور امیدوار باقی ماند.

به منظور دخیل کردن موثر شهروندان در فرایند وضع مقررات شهری می توان از تجارب موفق دیگر کشورها در این خصوص استفاده نمود. طراحی مدل مناسبی که پوشش دهنده انواع مختلف مشارکت شهروندان بسته به اهمیت موضوع باشد به عنوان پیشنهاد در این خصوص قابل طرح است. بر این اساس و با عنایت به لزوم فراهم سازی شرایط مناسب برای مشارک شهروندان در قانونگذاری شهری پیشنهاد می شود:

الف:  لزوم وضع قوانین و مقررات صریح به منظور سازماندهی نحوه مشارکت شهروندان در وضع مقررات محلی و پیش بینی سازوکارهای قانونی چون ابتکارات شهروندی و همه پرسی در چارچوب این مقررات؛

ب: تهیه برنامه های عملیاتی از سوی مقامات تصمیم گیر شهری و بطور خاص شوراهای محلی با هدف تضمین مشارکت شهروندان در وضع مقررات شهری از جمله پیش بینی جلسات مشاوره و مباحثه عمومی و بهره مندی از ابزارهای فناوری نوین برای انتشار پیش نویس مقررات و کسب آرای مردم؛

ج: ایجاد کمپین های تبلیغاتی و آگاهی بخش به منظور فرهنگ سازی برای گسترش مشارکت شهروندی و تشویق شهروندان به مشارکت.

چکیده [English]

The right to self-determination can have different dimensions including in the local area and in the role which citizens can take in local-municipal regulations. This research discusses the mechanisms of citizen participation in the regulatory process in terms of local councils and, through employing comparative studies, expresses distinct examples and models of this participation. Despite the good experiences of leading countries in this area as to engaging citizens in the regulatory process, the results of the research demonstrate that, although there is a possibility of a general deduction of this participation from the upstream legal documents, there are no mechanisms for participating in local regulations or they are very weak and scarce in Iran. The impossibility of systematic and rational participation of citizens in regulation can be one of the most important causes of ineffectiveness and lack of willingness to obey municipal regulations and increase in the economic and social costs of implementing city councils' decisions.
