Contracts and laws of contracts are among the important sections of a legal system, in which a major challenge is to determine the performance bond of the breach of contract. Hence, based on the predetermined goals, each legal system sets certain rules for the breach of contractual obligations and the performance bond.
In the law of the United States, a strict liability system governs the laws of contracts with the purpose of compensating and preserving contracts. Nevertheless, emphasizing different aspects of the effect of this liability, researchers have developed new perspectives on the fault-based enforcement of liability in recent decades.
In accordance with the Islamic jurisprudence, the law of Iran limits the claim for contractual loss only to the affirmation of parties, customs, or laws due to the contrasting opinions of Islamic jurists about the loss caused by the breach of contract. According to the laws of civil liability aim to fully compensate victims for their loss and put them in a position where they would have been if the contract had been executed, We can justified this kind of compensation based of attribute the damages to offending obligator.This subject is discussed in this article through a descriptive, analytical, and comparative methods.
