ملاحظات سازمان همکاری اسلامی در عادی‌‌سازی روابط برخی کشورهای عربی با رژیم صهیونیستی

چکیده

سازمان بین‌‌الدولی همکاری اسلامی که همگام با فصل هشتم منشور سازمان ملل متحد و در راستای حمایت از مبارزات مردم فلسطین، احیای حقوق سلب‌‌ناپذیر آن‌‌ها و نیز حفظ صلح جهانی و منطقه‌‌ای شکل گرفته است، کلیه دولت‌‌های عضو را ملزم می‌‌دارد تا به اهداف این سازمان پایبند باشند. درحالی‌‌که رژیم تبعیض نژادی صهیونیستی طی سال‌‌های متمادی در تلاش بوده است تا با طرح الحاق آرام سرزمین‌‌های اشغالی، مرزهای خود را گسترش دهد و پایبندی مشخصی به حداقل حقوقتبیین شده در قواعد و مقررات حقوق بین‌‌الملل برای مردم فلسطین قائل نبوده است، برخی دولت‌‌های عربی منطقه به عادی‌‌سازی روابط خود با این رژیم مبادرت ورزیده‌‌اند. مطالعۀ حاضر با تکیه بر شیوه‌‌ای توصیفی تحلیلی تلاش کرده تا ابعاد حقوقی بین‌‌المللی عادی‌‌سازی روابط برخی کشورهای عربی با رژیم صهبونیستی با توجه به ملاحظات سازمان همکاری اسلامی و ازمنظر حقوق بین‌‌الملل بررسی شود و از جمله به نادیده گرفتن مقررات حقوق بین‌‌الملل و الزامات منطقه‌‌ای از سوی رژیم صهیونیستی و لزوم حمایت از مردم فلسطین توسط سایر کشورهای عضو سازمان همکاری اسلامی، در حیطه اهداف و الزامات سازمان پرداخته شد. در همین راستا، بایسته‌‌های ایفاء نقش موثرتر سازمان در نگاهداشت صلح و ثبات منطقه‌‌ای نیز تبیین گردید.

تازه های تحقیق

رژیم اسرائیل که سال‌‌های متمادی قواعد و مقررات حقوق بین‌‌الملل را نقض کرده و صلح و امنیت منطقه‌‌ای و بین‌‌المللی را به مخاطره کشانده، همسو با پیشبرد اهداف تجاوزکارانه خود و در راستای الحاق آرام سرزمین‌‌های فلسطینی، به عادی‌‌سازی روابط با کشورهای عربی مبادرت ورزیده است. همچنین این دولت دهه‌‌هاست که با نقض حقوق مردم مناطق اشغالی، مانع تحقق حقوق حداقلی آن‌‌ها شده است. نقض‌‌های پی‌‌در‌‌پی صورت‌‌پذیرفته توسط این رژیم، جامعه اسلامی را برآن داشته تا به صورت یکپارچه جهت حفظ صلح و امنیت منطقه تلاش کنند و همین امر نیز موجب تشکیل سازمان همکاری‌‌ اسلامی شده است. سازمان همکاری اسلامی که در پی نیاز به راه حل‌‌های صلح‌‌آمیز برای منازعات منطقه و فراهم ساختن بستری جهت پاسداری و نگاهداشت صلح و امنیت منطقه و جهان، از گذر ایدئولوژی مشترک اسلامی ایجاد گردیده است را می‌‌توان موثرترین و چه بسا تنها گزینۀ پیش‌‌رو جهت کنترل نقض‌‌های مکرر رژیم اشغال‌‌گر و حمایت جمعی از مردم فلسطین دانست. از این‌‌رو تأکید بر ظرفیت‌‌های موجود در سازمان همکاری اسلامی و نیز ملزم نمودن اعضاء برای پیروی از اهداف و خط مشی‌‌های سازمان، گامی مؤثر در جهت برجسته کردن نقش این سازمان در تأمین صلح و امنیت منطقه و احقاق حقوق فلسطینیان قلمداد می‌‌گردد.

متاسفانه در برابر چالش‌‌های منطقه‌‌ای و داخلی موجود در باب مسأله فلسطین و گسترش ارتباطات سایر کشورهای عربی با اسرائیل، مردم و حاکمیت فلسطینی تنها تماشاگران منفعل تغییرات ژئوپلیتیکی منطقه بوده‌‌اند. رژیم اسرائیل با ترجیح الحاق آرام و عدم شناسایی وضعیتی مشخص برای مناطق اشغالی، و در پی آن با عدم شناسایی حقوق مردم آن سرزمین‌‌ها و همگام نمودن سایر دولت‌‌های منطقه با اهداف خود، تلاش نموده تا روابط خود را با سایر دولت‌‌های عربی عادی‌‌سازی نماید. بی‌‌گمان و بسان امری ناگزیر در آینده نیز شاهد آن خواهیم بود که مقامات اسرائیلی در راستای اهداف یاد شده خود تلاش خواهند کرد تا «الحاق آرام» و مداوم خود را به حداکثر برسانند؛ ازاین‌‌رو با نظر به این‌‌که تصمیم جمعی دولت‌‌ها در عدم شناسایی دولت اشغال‌‌گر اسرائیل و خودداری از گسترش روابط با این دولت، می‌‌تواند نقشی بازدارنده در الحاق سرزمین‌‌های بیشتر ایفاء نماید، و توسعه روابط دیپلماتیک با آن دولت به منزله پذیرش این نقض‌‌ها است، مقتضی ا‌‌ست که دولت‌‌های منطقه تا حد ممکن از عادی‌‌سازی و توسعه روابط خود با آن دولت اشغال‌‌گر خودداری ورزند. این امر مستلزم آن است که با توجه به اهداف تعیین شده در اساسنامه سازمان همکاری اسلامی و در نظر گرفتن حقوق مردم فلسطین، از جمله حق تعیین سرنوشت آن‌‌ها، همچون گذشته و آن‌‌گونه که بایسته است از منظر حقوق بین‌الملل به نقش دولت‌‌ها و سازمان‌‌های منطقه‌‌ای در این زمینه توجه بایسته‌‌ای مبذول گردد؛ از این جهت لازم است تا سازمان همکاری اسلامی رویکرد منفعلانه خود در مورد این موضوع را کنار گذارده و در مورد احقاق حقوق مردم فلسطین و ایجاد هماهنگی میان اعضاء فعالانه‌‌تر عمل کند. از سوی دیگر، اهداف جمعی کشورهای منطقه و نیز تعهدات عام‌‌الشمول آن‌‌ها ایجاب می‌‌کند تا تعامل مستمری میان اعضاء این سازمان برقرار و مقررات و سازکارهای مشخصی برای اعضاء تعیین گردد. در واقع کارآمدی بیشتر این سازمان تنها در پرتو وجود نهادی قوی، سازکارهای اجرایی صحیح، اتخاذ تصمیمات و تصویب اسناد حقوقی کارآ و همچنین استفاده از ظرفیت‌‌های قانونی این سازمان در حل اختلافات و وضعیت‌‌های خاص منطقه‌‌ای امکان‌‌پذیر است. در این صورت و در چارچوب اهداف سازمان همکاری اسلامی، انتظار می‌‌رود این سازمان با تغییر رویه کارکردی و خروج از شیوه منفعلانه خود در مسائل و منازعات منطقه‌‌ای، به سوی ایفاء نقشی مؤثرتر در مورد مسأله فلسطین حرکت کند و در همین راستا اعضاء را نیز ملزم دارد تا در مناسبات خود با رژیم صهیونیستی، در چارچوب اهداف سازمان و حمایت از حقوق مشروع مردم فلسطین، از جمله حق تعیین سرنوشت آن‌‌ها، گام بردارند و با محدودسازی روابط خود با این رژیم به یک راه حل منطقه‌‌ای اثربخش و در نتیجه صلح پایدار در منطقه دست یابند. با تلاش و همکاری جمعی اعضاء می‌‌توان امیدوار بود این سازمان در آینده نقشی مؤثرتر جهت حل چالش‌‌های منطقه و جهان اسلام ایفاء نماید.

The inter-governmental Organization of Islamic Cooperation (OIC) was established within the framework of Chapter VIII of the UN Charter to support the struggle of the Palestinian people, empower them to attain their inalienable rights, and ensure global and regional peace. The OIC requires all member states to adhere to its principles. However, despite the Zionist regime's persistent efforts to quietly plan the annexation of occupied territories and its failure to respect the minimum rights set forth in international law for the Palestinian people, some Arab states have signed peace agreements to normalize their relations with Israel. This study employs a descriptive-analytical approach to examine the international legal aspects of the normalization of relations between certain Arab states and the Zionist regime. It explores the Zionist regime's disregard for international law and regional requirements, as well as the need for other OIC member states to support the Palestinian people in accordance with the provisions of the Organization. The study aims to shed light on the dimensions of international law surrounding the normalization of relations between certain Arab states and the Zionist regime, highlighting the Zionist regime's non-compliance with international law and regional requirements, and emphasizing the necessity for other member states of the Organization of Islamic Cooperation to support the Palestinian people within the goals and requirements of the OIC. Additionally, the study underscores the importance of the OIC's role in effectively maintaining regional peace and stability.
