General average is one of the most important issue that have an undeniable role in maritime law. Since in Iran most of the goods import and export has carried by sea, therefore we have faced with the concept of general average at the time of entry of damages under certain circumstances. Accordingly, investigation the legal nature of general average and comparison with similar concepts and analysis it is necessary. Moreover, since many of provisions of civil rights has also investigated by the jurisprudence, this issue has disputed in jurisprudence. Although, general average is similar with other concepts in maritime law. That this concept matched with the intentional damage to keep the ship and cargo accompanied by maintaining its necessary conditions and the same things duplicating the importance of new concept investigation. it should be noted that the concept of general average has been disputed scrutiny and discussed in countries where have maritime law system that we will argue for discussion.
