رویکرد کشورهای اسلامی حاشیه خلیج فارس به موازین بین‌المللی حقوق خانواده

چکیده

موازین بین‌المللی ناظر بر حوزه خانواده از منظر چند شاخه حقوقی مشتمل بر رشته‌های حقوق خصوصی، حقوق بین‌الملل عمومی، حقوق بین‌الملل خصوصی و حقوق بین‌الملل بشر قابل مطالعه است. به رغم تصور اولیه مبنی بر تحدید موازین مربوط به خانواده در چارچوب حریم خصوصی شهروندان، باید گفت حوزه مزبور متضمن موضوعات متنوعی است که با نظم و امنیت عمومی و اخلاق و سلامت همگانی در ارتباط است که ممکن است در سطح ملی یا منطقه‌ای پیامدهای متنوعی را به ‌بار آورد. کشورهای حاشیه خلیج فارس نسبت به موازین بین‌المللی تثبیت شده یا در حال شکل‌گیری حقوق خانواده کنش‌ها و واکنش‌هایی داشته و دارند که به ویژه در عرصه‌ی نهادهای زیر مجموعه‌ی سازمان ملل یا سازمان همکاری اسلامی یا در تعامل با سازمان‌های غیردولتی بین‌المللی جلوه‌های متنوعی به خود گرفته است. در مقاله حاضر ضمن تمرکز بر تحرکات کشورهای حاشیه خلیج فارس در تعاملات ذی‌ربط با سازمان ملل و بیان مصادیق مهم مطرح، به واکاوی این پرسش می‌پردازد که آیا رویکرد کشورهای مذکور در این عرصه منسجم و هماهنگ بوده یا به تنوع در رویکرد دچار است؟ به علاوه این رویکرد واحد یا متنوع در برابر موازین بین‌المللی خانواده چه پیامدهایی بر صلح و امنیت منطقه ای در بر دارد؟ به این منظور اسناد بین‌المللی ذی‌ربط از منظر حقوق بین‌الملل عمومی و حقوق بین‌الملل بشر تحلیل شده است تا از این طریق پیامدهای اقدامات کشورهای مزبور در این عرصه بر صلح وامنیت منطقه ای کاویده شود، و پیشنهادهای نظری و کاربردی برای نهادهای مسؤول در جمهوری اسلامی ایران نیز ارائه شود.

Abstract: 
International Instruments on Family can be studied within various fields including Private law, Public International law, Private International law and International Human Rights Law. Although, at the first glance, it seems family instruments are just related to privacy of citizens, it covers different themes associated with public order, security, morals and well being of community which have effective outcomes at national and international level. The Persian Gulf countries have interactions with international human rights mechanisms. The main question of this paper is whether the approach of Persian Gulf Countries toward international family instruments is similar and cohesive or they have adopted different and contradictory approaches and what is the impact of their united or divergent approach on regional peace and security. The methodology of this paper is to analyze International family Instruments from public international law and international human rights law perspectives. The paper will be concluded with some theoretical and practical suggestions and recommendations for the policy makers and related authorities of Islamic Republic of Iran.
