Many Western thinkers basically separate ethics from the category of law and For man, immoral legal rights are allowed. Thus the "right to be wrong" is formed in modern human rights. Today, the basic principles of this right, such as the separation of law from ethics, non-interference of the government in standardization, acceptance of the right to civil disobedience are considered as principles of legislation. However, some other Western legal thinkers have undermined the certainty of these principles and consider the acceptance of the principles of this right to lead to the unrestrained rights. Islamic thinkers, unlike Western thinkers, believe that the source of right belongs exclusively to God. Man is required to follow the divine commands to achieve eternal happiness. They consider it the duty of the government to create a culture for guidance. They believe that it is only the divine law that is comprehensive of morality and law and can lead man to salvation. Moreover, the possibility of disobeying Islamic law is absolutely not possible, Unless civil disobedience is done in accordance with moral principles and outside the scope of obligations.
The research was conducted by the method of collecting library information and by using the method of descriptive research and the method of text content analysis, within the framework of legal knowledge and with the information collected through phishing.
